But it you're at home playing in the yard with the kids, I feel its a bit much. I know of a story where a guy who just got a raise at work and bought a new car (I think it was a vette) got a DUI sitting in his driveway. He was listening to the radio in his new car. If he was on the street with it, which it sounds like he was, then he was putting himself in serious danger of getting hit by a car. As far as I'm concerned, if you're on a public street, and are in control of anything more advanced than running shoes, you're eligible for a DUI.
