TTQ B4U Posted May 15, 2008 Report Share Posted May 15, 2008 If someone filed for relief earlier than 6 months before February 13, 2008, when the Stimulous package was signed into effect, they may likely be allowed to keep it. However, if not, they will likely lose it to the bankruptcy courts as it will be used to pay towards general unsecured debts like credit cards. The money is an asset and that may be taken by the bankruptcy courts if the bankruptcy debtor can’t exempt the money. Timing is everything. Just the same, you can't give away moeny, property or even trade in a car with equity in it just prior to filing either. That's fraud. If you've already filed, they will not allow you to spend it on the below items and keep the money. Recipts or not, you will be required to give up the refund. In fact, most all of my wife's clients aren't even getting them as they are being taken out automatically.....as they should be.
