banking people...0% apr on cc transfers?

Evan, if I were a debtor and you told me over the phone that you were going to sue me, I would immediately file in small claims and either have my debt wiped from your company if below $1K, or reduced significantly if over. Yes, I know if you intend to sue you are not breaking the law, but your company would settle before we got that far because the threat is questionable.

 

we already gave her the option to settle at 85% 2 months ago, and i pitched her a 70% settlement before i sent her the letter. i have full intentions on letting our attorneys sue her. its not a small balance either. its close to $3k.

 

you can threaten a counter suit at me all day long, nothing will happen. when it gets to me, you've had 7 months of delinquency, we have clear documentation of the attempts we've made to contact you in those 7 months, recorded phone calls of all conversations, including those where we agree to settle an account, and you refuse it. no court is going to side with you

It doesn't matter if the court will side with me or not. It will never make it to court.

 

Also, I never threaten to sue. I file without warning once I have my evidence in place.

 

Keep in mind I'm not angry, just telling you how I would handle it. Very few people would react the way I do.

lol. what "evidence"?

 

"your honor, this company has threatened to sue me for this $3,000 balance that i have not paid in over 7 months, which they have also given me the option to settle for 70% of my balance due"

 

"well, why didn't you pay it?"
