spankis
So, I got my first Env3 last October, and since then I've gone through 3 Env3's because they are horrible pieces of shit. They have an issue where the batteries lose contact and turn off in your pocket, and you don't know this until you go to use the phone. Well, when my latest one started doing this they tried to give me a 4TH Env3 and I refused. All the current alternatives to an Env3 require $10 data plans as mandatory, and I use absolutely no data at all, so I don't want to pay for that. Either way, they decided to give me a Samsung Reality in place of my shitty ass Env3, and are now going to apparently charge me $10 a month for a data plan that I don't use. In my eyes, my contract entitles me to Env3's level of technology and functionality, at the existing rate I was paying, without any data plan. I'm not responsible for their current lineup of phones lacking a comparable product not requiring a data plan. Why should I have to now pay more for what I was initially entitled to receive according to my existing plan? Is there a way around this? All I keep hearing is that it's their new structure, while I keep telling them that my agreement falls under the older structure....
Guest tbutera2112
good fuckin luck....those crooks would not back down AT ALL with my girl, and she was in the same position as you, also with an env3...finally just gave in and we got her a touch and she pays the $10 now and chocks it up as a rates increase....its bullshit, but it is what it is.. phil
After ur 3rd replacement they should give u the next upgrade to that phone. You have to have the 10 data plan now on any phone with web browser accpet smart phones which is 30. Sorry
Nitrousbird
Good luck. We had to fight them tooth and nail to get them to prorate the 3 fucking days of service we used (post contract) before switching to AT&T. They wanted to charge us a full month. This is after their CSR had already told us, before we switched, that it would be prorated, and they had it documented in their system that they told us this! That said, if they are unable to hold their end of the contract, you may be able to get out of it and go elsewhere......

C-Mart
The only thing is with certain phones you HAVE to have the data plan. Its not up to the person in the store. You are better off going in there and trading in for a decent phone that does not require one...
spankis
Thanks for the input. The deal is this though. The phone has a browser, yes. I had the guy look up how much data I had used since I got the env3 in October, and it was ZERO. I don't enjoy paying for services I don't use. The env3 had the same browser setup as this new phone I'm getting, which is not a real browser like true smartphones have. And Phil, my issue is that it's not that black and white at all. I'm not walking in there and choosing to get a new phone of my own volition, I'm being forced into a different phone because the shitty technology they issued me didn't perform. I feel I should not be forced into a different rate/plan in order receive the services my EXISTING plan entitled me to. Phil, if you can tell me that everyone I speak to is going to refute logic and flatly reply with the policy you've given I guess I'll maybe go another route.... Persona.y I don't care what route u go, I'm jus telling you ur options. And don't give me that I'm in school I can't get a job bull shit. I go to the same school u do with probaly less time since I have a job and play sports there. Maybe u should stop renting porn so much and ull have an extra 10 a month to stop crying about it. And if u don't use browser get a phone that doesn't REQUIRE browser plans. That's like getting a blackberry and saying I don't wanna pay the 30 extra cuz I don't wanna use the phone for what its for. To bad bitch that's the rules. Either pay it or get another plan.

I got a phone that didn't require this plan, and it took a shit. Not my fault. The phone it's being replaced with now requires a plan, and comparable phones are no longer offered. I have to downgrade to fucking awful phones in order to NOT pay for data I don't use. Where am I responsible? I've not yet received the 2 years of service on the Verizon phone that I'm in contract for, at the rate I'm in a contract for.

If they are giving you an option on rather to pay or not to pay then there's the out clause. Seeing as they upgraded your phone then you may have to pay more for an upgraded feature. You bought that perticular phone, if its discontinued then you are shit outta luck. So u can down grade and not pay or u can keep the upgrade and tough it out. They are not forcing your hand. Its not your fault the phone broke but if its no longer offered then its no longer offered. They won't write you up a personal contract for your inconvience. Deal with it

As it stands, no changes to my contract need to be made in order make this new phone coming in the mail tomorrow function. The only change they're trying to make is that any data charges I may incur be dealt with through a 25mb plan, or through my existing per-kB rate ( neither of which I use ). They ARE forcing the plan change. They aren't going to discount my plan if I take a shitty phone. So why should I give them more money if the replacement for my discontinued phone requires it when packaged with a plan. I'm not changing plans, I'm changing phones, because their lack of quality product FORCES me to.

An out clause would be to buy a phone off someone else and turn the new phone in until ur contract is over. Keeping your old rate w\o 10 extra. I do have a brand bew voyager that u can have for 50 that won't require a data package
Guest tbutera2112
^ phil, youre incorrect on that. after jan or feb, i forget the date they told me, even a voyager requires the data pack if its a new sign up phone....people who had the phone before, dont have to add it, but anyone who adds the phone on after jan or feb 2010, has to have it....just went through that whole process with my girl.... env3, env touch, voyager all required data packs, and they would not budge on that AT ALL (her env2 was a pile, and we were trying to find her an upgrade)
phil
If its an upgrade, not if u jus add it on. Fine lines my man fine lines. I.e, if he lost or had his phone stolen, and had the voyager laying around and put it on then no he wouldn't. If he upgraded to it then he would

V8 Beast
A few things... -They should offer you a phone that doesnt require the $10 crap. -The contract is not being voided. The warranty is set by the companies that make the phone. If you go by the warranty you would have to keep getting the same phone infinity times. If you choose to go to a different phone its still a choice. If you dont want what is being offered you can stay with the same phone. -Going up the corporate ladder for what you want is a waste of time. The economy is not good enough for you to bitch to get what you want. Try it again in a year. -If you activate a phone that you did not purchase from them then there is a way out of the $10 with old phones like the voyager. You might even be able to go online and take it off yourself...
Ry_Trapp01647545522
i don't see the issue. simply put, they don't offer your "level" of phone any more, so you either take the upgrade(next "level" up) and pay the extra $10 or you downgrade(next "level" down) at the cost of using a shittier phone. what do you want them to do, make a special phone just for you? i mean, hell, they are giving you an upgraded phone that you would otherwise have to pay more cash for.
