NEW ALBANY -- A Buckeye Lake police officer was put on unpaid leave after he was accused of driving impaired in New Albany.

 

James L. Petrey, 58, of Newark, was charged Tuesday in Franklin County Municipal Court with operating a vehicle while intoxicated, a first-degree misdemeanor. The offense is punishable by up to six months in jail and a $1,000 fine.

 

Petrey is suspected of threatening a woman he knew while holding and "flipping around" a gun inside a vehicle parked at a Johnstown Road restaurant on Jan. 12 in New Albany, according to a police report. They were arguing about the status of their relationship, and Petrey allegedly pointed the gun at his own head when the woman left the vehicle, according to the report.

 

The woman called police, but Petrey had left the scene by the time officers arrived. He then began calling the woman and later returned to the scene, where police detained him. Several handguns and empty beer containers were found in the vehicle, the report reads. Petrey failed a field sobriety test and was arrested.

 

Buckeye Lake Capt. Jim Hanzey and Chief Ron Small went to New Albany after learning of the arrest and retrieved two weapons -- one used in the incident owned by the police department and another personal weapon, Hanzey said.

 

"I think they are handling it as best they can," Buckeye Lake Mayor Rick Baker said. "They responded immediately, drove over and checked it out."

 

Petrey, an hourly employee, was placed on unpaid leave after an internal investigation, Hanzey said. After criminal proceedings, Petrey will have a hearing with Small and Baker, the mayor said.

 

Petrey previously had been disciplined. In July 2008, he was suspended for driving to Grove City in a village cruiser to confront a man. Petrey forfeited his pay for the July 27 shift and compensation for a day of firearms training for the offense.

 

Petrey has not had disciplinary actions since 2008, Hanzey said.

 

Before serving at Buckeye Lake, Petrey worked for the Licking County Sheriff's Office for 22 years. He was fired in 1999 after an internal affairs investigation accused Petrey of 21 departmental violations, according to a records request at the time by The Advocate.

 

Petrey ran for Licking County sheriff in 2000, losing to incumbent Sheriff Gerry Billy. He tried for the top spot again in 2004, running against then-Col. Randy Thorp, but he was disqualified by Licking County Board of Elections officials. They found Petrey lacked experience as a supervisor and had not worked as a full-time police officer in the five years before his bid, as required by Ohio law.

 

An arraignment on Petrey's OVI charge is set for Thursday morning.

 

 

How can you be found guilty of 21 violations as a sherrif and allowed to be an officer of the law somewhere else? Doctors lose their license to practice medicine, why is an officer different?

Wow, just amazing. To think this asshat was going for a Sheriff spot!

 

What a disgrace. I suggest maximum sentencing. Can't they get him on any kind of felony for menacing or whatever? Doesn't sound like someone who should be allowed to own a gun.

I don't agree with it but, they were departmental violations and not laws. I would be interested in what they were.

Small departments pick up scraps from others sometimes. Thats all Im gonna say about that :no:

Not to be overzealous, but that just sounds horrid. Smaller departments probably investigate internal issues less than big ones (or have less resources available to do so) so guys like this can just freely do shit.

So he took a cruiser to start a fight with someone. What was the other guy supposed to do beat up a cop? And all he got for this is giving up a days pay and union hours, and to go to firearms training for a day. Seems like a slap on the wrist.
