John Posted July 18, 2009 Report Share Posted July 18, 2009 thats maloney v cuomo right? where the 3 judge panel ruled that the prior SC precedent (from presser in 1886)that the Amendment only applied at the federal level is still binding law. interestingly enough the 9th just ruled that the second DOES apply to state and local governments. these circuit splits will usually result in the case going to the top.if maloney makes it to the SC, she would have to take herself out of consideration on that case, due to her previous ruling on it. John Posted July 18, 2009 Report Share Posted July 18, 2009 also, if she does take part in the next round of 2A cases, its not really clear what difference she will make. she is replacing souter who dissented in heller. if the same 5 who made up the heller majority ruled that it does reach below the federal government her vote would probably not be decisive.
