In some states yes. Mostly considered trespassing, so it's a minor misdemeanor, dealt with by the local officials.

i dont even know how they'd catch him. it takes a while for a train to come to a stop. granted that one was not too big... but still maybe a half mile?

he would be long gone by then.

I was thinking more that he posted it on youtube. But seeing as there are tons of vids out there with illegal activities in them, I doubt that will happen.
