The correct process is file a lawsuit against it, or if charged with it base your defense on the law being unconstitutional. If the low level judge follows with the city, keep appealing until you get to a judge that isn't a moron and actually believes in the Constitution. The only way the Fed would step in, in this process is if it makes it all the way up to the Supreme Court, and I don't see that happening.
