The smokers have no right to smoke in a restraunt. Non-smokers have no right to clean air in a resturaunt they CHOOSE to go to. the only "Rights" violated are the buisness owners. Conemashers point: -Smoking in restaurants should not be allowed, I agree, kids should be our first priority, their health and safety are our future. if kids are the first priority, then why not fine or jail smokers who smoke in thier homes with kids? Sorry folks, there is NO placew in the constitution that says you have the right to eat at Applebee's or The Outback without smoking. But as a responcable adult you can CHOOSE to eat at applebee's because there is not smoking, not because the government told them they couldn't, because they made a buisness decision.

Bars and resturaunts are PRIVATE establishments. What is next, somone can't smoke in thier own home if a non-smoker is visiting? I agree people should not have to endure smoking in public. Too bad the ban isn't against "public" places.

The ban does infringe on the rights of the owner. Sorry, but you don't have the RIGHT to clean air in a resturaunt. WHY? Because you CHOOSE to be there. no one has ever tied you up and made you sit in a bar/resturuant. In a public place, in your home, you have every right, but not in a private setting. Amazing that many of the people who bitch about freedom being taken away voted FOR this. Freedom is not about what you like, it's about protecting what you don't like. BUT, the ban should have never happend, I think it would have been better to compromise, bars should stay smoking, but resurants have to have thier smoking section enclosed from the non-smoking section. If the owner didn't want to pay the extra money for building a glass wall separating the non-smoking section, then smoking is not permitted.
