The driver should strangle him. There is a very good reason there are speed limits. If you're making a left turn in a 35 mph zone, and you see a bike 100+yds away, you dont expect him to be doing 70. If the rider had been doing the speed limit he would have never hit the car. He impacted at at highway speed, and you can see by the nose dive that he was braking.
