In order for the warranty to be honoroed it's sent out and since you've modded it I hardly see that the warranty will hold true. Mines also modded and when I tried to replace it after it screwed up from the Super Mario Galaxy update I ended up have to buy another one since they knew I opened the case when it was sent to the warranty company.
