I believe that in Franklin Co. the fine is upwards of $140. I read that had you received a written warning, you would have removed it. USUALLY, in Franklin Co., if you go to a professional shop and have it removed, take the receipt to court, and show the prosecutor, they will drop the charge. It is not a guarantee, but is a real possibility.

Lets just say that it has been my experience that it only shows things that change the title. I signed up for the unlimited check in 2006 when I was looking for a new vehicle. I was curious what it would show, so I ran the van I was getting rid of (which I personally wrecked and reported in 2005) but nothing showed up. I then ran another vehicle I knew to be wrecked and reported...nothing. I checked 2 more that I knew to be wrecked with the same result. Never used it again.

Carfax only shows accidents that have an impact on the title (totaled).

It's not stolen if that is what you are looking for.

I think I want my next bike to be a BMW K series also. I have been so impressed with them that I am concidering purchasing one from them and riding it back (when I get the money). We go down and visit my in-laws in Ft. Myers every spring break.

That is why I said it is gray area. In Franklin County that charge would never fly. We have an extremely liberal court system here. While it may illegal in Ohio, Franklin County interprets the law differently. But to be honest, I would have a hard time seeing that happen anywhere (just my oppinion).

They seem to have a great staff. Even when I told them I was from Ohio and wasn't buying a motorcycle on vacation, they still asked me if I wanted to take a test ride. They also spent about 45 minutes shooting the shit about motorcycles (even with other customers coming in...they took care of them also but kept coming back).

To the OP...Since you are in Florida, have you looked at Gulf Coast Motorcycles in Ft. Myers? They usually have a great selection of used K series bikes. The last 3 times I was there, they had a minimum of 4 each time. 16090 South Tamiami Trail Fort Myers, FL 33908 (239) 481-8100

There is a lot of gray in this area. Basically, it comes down to intent. Your car, motorcycle, scooter, butter knife, ink pen, can of soup...etc can be considered a deadly weapon if you intend on it causing harm to a person. If a homeless person carries a steak knife to cut the occasional piece of meat he comes across, he is legally carrying it. If he is carrying it because "the streets are rough and I got my ass kicked last year", he is carrying a concealed weapon. I drive my truck to take the kids to swim practice. My truck is not a deadly weapon. However, should I see a person that I have had a beef with and I swerve to hit him with my truck, now it is a deadly weapon. It is generally accepted (in central Ohio) that a knife that is in plain view, i.e. inside your pocket with a clip on the outside or on the outside of your clothing, is not a concealed weapon because it is immediately apparent what it is. When I was a brand new officer, I arrested 2 people who had just broken into some cars. As my coach was searching the first one, I searched the second one. The one that I searched had a machete handle sticking out of he backpack. My coach began to question me about what all I was going to charge him with. I ran through the things from the initial offense...criminal damaging, theft, etc. Then, I said misdemeanor CCW. At that point, he told me to call another officer (who also is an attorney) to get his opinion. I was told that I could not charge him with it because even without seeing the blade, I immediately knew it was a machete by seeing the handle, which meant it was not a concealed weapon. Hope it helps (although probably didn't).

It's pure adrenalin, I have been there myself. You get injured before/while going hands on with someone and adrenalin takes over. Once you get them in cuffs, the pain sets in.

The first part was a joke (for the most part) and the second is just a fact. The Ferrari was used in the commission of a crime. In this case, a felony. Therefore it is seized as evidence until the trial is over. It has nothing to do with egos. The only ego that came into play was that of the driver. He clearly is one of the types that thinks his shit doesn't stink because he can afford a Ferrari.
-
If the driver had and eightball between the seats, then he is an idiot for getting in the car to begin with. Stand on the sidewalk and laugh at the idiot getting the ticket. Then, when the cop walks on, get in your car and drive off. I like your style!
-
How do you figure the cops actions were unnecessary? The asshat in the car went from a minor misdemeanor parking citation to a misdemeanor Obstructing Official Business (arrestable offense) to a Felony Assault on the police officer. He had better be glad he didn't get his ass kicked after he was removed from the car. After that was done, his precious Ferarri should be impounded to car jail as evidence and not released until the case is disposed of in court.

You have stated nothing but speculation! First off, if someone was knocking at your door at that time, you are an idiot for opening the door without knowing who it is. The account of the incident that I personally read stated nothing about them going inside. The report said that the officers knocked on the door and the resident answered aiming a gun at them. I have been on a few house to house man hunts looking for a violent criminal, and not once was it ever necessary to force our way in. Even if the officers knew that he was inside, they are not going to force their way in to apprehend a muder suspect. They are going to make it a S.W.A.T. / C.R.T. call out and then begin P.A. announcements informing the residents to exit the home or officers will make entry to the structure.

Where is the illegal search? They knocked on his door, and that is not illegal.
