I sent a certified letter to the contractor yesterday. I included a copy of the quote to fix the driveway. I will see if they will call me back. If I do not hear from them by saturday, then Monday it is off to small claims court.

You could always hold a retainage of the money you were suppose to pay him. That way just tell him he will get the remainder of his money after the damages are fixed on his dime.

I owe them about $1500 on the job. The estimate to fix the drive is $2500. At this point, the owe me 1K.

No word yet. I am going to make a personal collection call tomorrow.

So I made my personal collection call today. They guy was not in the office, so I told his girl at the office that he needs to call me today. About 15 minutes later he calls me on my cell.

We had a discussion about if he is going to fix the damage or not. He said he is willing to do a "patch job". My answer was "I don't think so. It was not a patched driveway before, and its not going to be on now. So at this point it looks like we will end up in court about this whole ordeal. In the mean time I will be growing mosquitoes bye the thousands due to the standing water in my yard.

That blows, I'm not sure what he means by a patch job, but if can make it look like new maybe settle for that and keeping your $1500 that was still owed. That way you end up with a fixed driveway and saving $1500 on the job?

 

Either way it sucks, but dragging scumballs to court is never fun and might be a waste of time if he is not fully bonded/insured/set-up as a business. And even if he is, who's to say he'll follow through with any court orders.

I can't help you with the contractor or the driveway, but I may be able to help with the other thing.

Dump some oil on the surface of the water and it will provide enough of a coating that the mosquito larva will not be able to breath. Canola works fine for this, it doesn't have to be 5w-20.
