The name derives from Terry v. Ohio, 392 U.S. 1 (1968),[2] in which the Supreme Court of the United States held that police may briefly detain a person who they reasonably suspect is involved in criminal activity;[3] the Court also held that police may do a limited search of the suspect’s outer garments for weapons if they have a reasonable and articulable suspicion that the person detained may be “armed and dangerous”.[4] When a search for weapons is authorized, the procedure is known as a “stop and frisk”.

 

The cop can clearly see he is armed, the person in question could be a felon and possessing a gun illegally. Do you really think a cop is going to allow someone to walk down the street possessing an open firearm and not stop to ask questions?

 

There was a video posted a while ago of a guy in San Diego (I think) open carrying, who had a cameraphone record his encounter with police. The officer stopped him, made sure he was exercising his rights in a legal way, let him know why he was stopping him (he'd gotten calls, people were worried), and sent him on his merry way without causing a ruckus, even though the guy was somewhat confrontational.

A cop can stop you for any reason at all. However in order to arrest there must be a law that's broken. Carrying a legal sized knife isn't illegal if you are carrying it as a tool. I would say its hard to argue the knife isn't for self defense when you're openly carrying a gun and concealing the knife.

 

Id disagree. To me its less likely the knife is for self defense if he has a freaking gun...

Under that line of reasoning we should all be stopped while driving because anyone they see could be driving in some illegal manner, ie without a lisence.

 

A line is drawn for a reason or we would live where we get stopped for the "paper please" question all the time.

Unfortunately we've already allowed police to encroach upon our freedom of travel, and unlawful searches via the wholly unconstitutional DUI checkpoint.

 

Fuck it though, these guys are just trying to protect society from itself so let's just tolerate it.

Is it illegal to do so? Not at all.

 

There was no crime committed around the area he was at, no MWAG call...there is no reason to stop a law abiding citizen.

 

It's like saying a cop has a right to pull you over and search you because you drove through a high drug area...even though you are driving the limit and not violating any laws.

 

How is carrying a gun legally any different?

 

ORC 9.68 says it is not illegal to openly carry a gun, and no city can make laws against it
