They collect sales taxes, and don't pay to the state. State will allow 2 quarters to go by with several penalties......then they get shut down. Most never reopen. If they are short cash so much to not pay the sales tax to the state, business was upside down.

It's the franchisee...other Smashburgers are not affected by the actions leading up to local closures.

 

They're currently looking for an angel investor to clear the tax burden and take over the franchises. Whether that's someone local or HQ isn't clear. HQ probably doesn't like it when their franchises close down and have giant signs basically saying "OUR BUSINESS SUCKS SO MUCH WE CAN'T PAY OUR BILLS".
