The story I read was that the motorbike was on refugee road, the car was also on refugee road, and the car turned left into the path of the bike. A v-indentation in the front of the car indicates that the car turned while the bike was VERY close to the car. If the biker was further back then the impact would tend to be on the passenger side of the car.

That article has almost as much bias as typos. Having said that, I believe that the basic concept is solid - that NBC, Sharpton and the Martin attorneys have created a racial element to this case that never existed. I believe that they did this for their own personal gain, and ignored the damage that is being done to Zimmerman, the community and to the coutry as a whole. I also know that uninvolved people are suffering physical assaults as a result of that racial tension - those people should sue too. I don't know if Zimmerman is guilty of murder, however there is no evidence of any racial component (and overwhelming evidence that he is not a racist at all).

The furor meant he had to quit his job and go into hiding for his own safety. Demonstrable financial harm here would be the difference in cost associated with travel between his place of hiding and the court (versus traveling from his home), costs of lodging where he is now, any security measure he has had to implement (bodyguards, securing the building he is living in etc). Loss of income from to having to quit his job due to his safety being jeapordized by the actions that form the basis of the tort is definitely recoverable if the judge so rules. Intentional infliction of emotional distress is not something you can put a dollar figure on. This lawsuit is a little premature - it will stand much better chance of success if he is found not guilty. Even more so if the case is dismissed. Nobody wants to give this guy money then see him subsequently convicted. Spike Lee needs to get sued too - he's the guy who retweeted a child's home address (Wrong George Zimmerman) and drove a family from their home due to death threats.

Look at the size and shape of his nose before and after the hit. It's clearly broken displaced. Closed Reduction surgery is in his future.

Same deal with road rage. Remember my road rage video? I could have got out and faced off with him, or stayed in the car and wait for the police. The first option, favorite we e-thugs the world over, would likely have earned me a disordely conduct charge at best, or getting stabbed/shot at worst. The second option was the smartest.

Friend of mine did 3 years for a similar thing. He got into a mutual combat fight in a bar and was knocked out cold. What he came to the guy was standing over him and said he was gonna kill my friend. My friend, on his back on the floor near some chairs, saw a broken pint glass under a chair and grabbed it, shoving it into the other guy's face. A hundred stitches, as i recall. He was arrested and charged with "Assault Occasioning Grevious Bodily Harm". Sentenced to 3 years, served 18mo. This was the story my friend told. I have been in fights when i was younger, and yes, those days were a lot more tolerant of two guys "settling their differences" with a fight. I always freak out when i hear of self defense stories ending with charges because i worry about getting charged myself in a self defense situation. So i try to understand why the courts didn't agree with the defendant. It is important to understand what is and is not allowed.

He insists it was self defense and the court said it wasn't. I'm just trying to break it down and help him understand why the court feels that way. I twice wished him all the best. I already said i don't care because it won't change anything. If he wants to debate it beyond that then i'm open to debating.

How did he get a cut big enough to need 14 stitches? Did you use a weapon, or did he fall and hit his head against something? How long was it between him hitting you and you hitting him back? Seconds? Minutes? Hours? How far was it from where he hit you to where you hit him? Same spot, or somewhere else? What was the greatest separation of distance between you and him between him hitting you and you hitting him? 2 feet? 5 feet? 50 feet? Did either of you walk away and then come back? Do you recognize that our laws don't allow people to "regain their honor" by taking revenge for a prior assault?

Generally speaking, if someone smacks you and you walk away then that's it over with. Call the police if you want. Don't come back later and start something new. That's speaking generally, not specifically about your case. I read the appeals court decision. The original jury felt you started a second confrontation making the original aggressor into a victim, and the appeals court affirmed by rejecting your assignment of errors (Both weight-of-evidence and inadequate-counsel). (They said 14 stitches, not 8?) So what really happened? I don't know, I wasn't there. I don't care, because it won't change anything. Like I said, I hope things work out better for you from now on. Good to see any rider back on two wheels. 225hp has gotta be a handful.

Much more to the story, it seems. Remember what I've been saying about the Trayvon Martin case? - Zimmerman's "Second Confrontation" defense theory requires there be a separation of time and/or distance between the two events (enough to allow a reasonable person to cool off) in order for them to be considered separate. If they ARE considered separate events then original agreesor can become the victim. OP: Hope all works out better for you from here on out. Good luck.
