AudiOn19s Posted July 13, 2005 Report Share Posted July 13, 2005 Here's how it works...the DOT had to have been notified prior to your incident that the pot hole in question was a problem...If they were aware of it and it had not been fixed when you hit it and caused damaged they are liable. If there are no reports on hand with the DOT that this was an issue they won't pay. Went throught this awhile back and took pictures, filed a police report everything...no good cause they weren't aware of the hole that I hit! I was awarded shit.
