Straight from the article you posted - Although the law specifies that only "a physician, a registered nurse, or a qualified technician" can draw blood from a motorist, The officers can only do it if they have gone through a training course. What is to stop some cop that is pissed he's on patrol today and he decides to stick you, maybe even if he doesn't smell alcohol, but says he does. Power is a fucked up thing, and some people can't handle it..... Nurses have to get a License from the state of Ohio, to draw blood, My wife is an RN and she had to become a RN to draw blood for her job, Not take a 24 course...... Cops have no business sticking people with needles. I would have no problem with the law except is scares me to read "that if the person refuses to take a chemical test the officer may employ whatever reasonable means are necessary to ensure that the person submits to a chemical test of the person's whole blood or blood serum or plasma," What he calls in his buddies and they hog tie you and stick you? If the law was "arrest me and take me to a local hospital to have blood drawn", I would say ok. Also if you draw blood on a person that comes back .00000 the cop should have to pay restitution and loose his/her license to be a peace officer. Why not enforce the current laws better. Giving a cop the right to do what ever he fells he needs to do to get a blood sample is not right. So pretty much if someone refuses, the cop will have the right to taze you or cuff you, slap you into the back of a cruiser and jab you with a needle?!?!?! Just not right... But of course neither is drinking and driving.... I'm glad I'll never and I repeat NEVER have to have this done to me.... If I drink I do it at home. The last time I did drink I had a terrible hangover that really made me think... "Is drinking really worth this kind of pain?" Hell no! If you drank the night before, responsibly spent the night at your friend's house, and left the next morning would the test be positive if you get pulled over on the way home? We actually had that happen to us one new years it was a breathalizer though.. Went up to a freinds house drank all night of course, got up the next morning to drop someone off at work and got pulled for speeding.. (late gettin up damn hang overs!!) Anywho the girl that was driving got taken into the station and i think she blew the cop to get outta a DUI.. Giving MORE power to people who abuse it already (not all) is a bad idea. I’m a big believer that giving the Govt. more power is a bad idea in general, just another way they have control over us, instead of the other way around. There has to be a better way then this. Maybe after the 2nd DUI’s they impound your car for a month. I don’t drink and drive but to say this only affect those who do is wrong. This is just opening the door to other things. Someone is raped and the suspect matches your description. Well there is a law in place to catch drunk drivers why not make a law that catches rapists too? Next thing you know you get a knock at the door from the cops saying you HAVE to give blood to clear yourself. All I’m saying is that once it’s on the books it’s not too long before they find a way to justify it in other aspects of personal invasion. I know that blood and DNA samples are different, but I thought, why not just jack off on the cop and give him a sample that way! Lol, but I fail because they’re not the same….or are they…!? I think they do 'impound' your vehicle on the 2nd DUI. A buddy of mine had the Club put on his car (at his house) by the Hilliard police after his 2nd DUI. He wasn't allowed to even move his car for any reason and the club was on there for about 6 months IIRC. They took his tags too. There are plenty of DUI punishments that never get used...... Repeat offenders should have theirs taken away, because obviously they can't seem to figure out how to function in normal society. If you have multiple DUI's I see no reason not to charge you with attempted murder. Every single person in America knows the possible results. It is no different then taking a handful of blanks and a handful of live ammo throwing them in a bucket and pulling a random round out, then firing the gun into a crowd. I am sick of seeing loved ones and friend's getting killed or seriously injured because some asshat couldn't be responsible enough to hang his keys up before he started drinking and leave them there till they are sober. Anytime you drink and drive you put yourself and every other law abiding citizen at risk. This just closes loop holes that allow people to get out of DUI's. If people were more responsible laws like this wouldn't even be an issue. Try looking up foreign countries punishments for DUI and see which you like better. Many countries begin punishment at .02 bac. Third offense in Ontario gets you a lifetime suspension on your license. New Zealand sells your car, and forbids you from owning one for 1 year after multiple offenses. Any vehicle you own in the 1 year is also siezed and sold. Most countries also allow RANDOM breathalyzer. No reasonable suspicion needed. Alot of them also mandate a breathalyzer after any accident. Here are examples of some other extreme reprecussions in foreign countries: Australia The names of the drivers are sent to the local newspapers and are printed under the heading, "He's drunk and in jail." Malaya The driver is jailed; if he's married, his wife is jailed too. South Africa A 10 year prison sentence or the equivalent of a $10,000 fine or both. Turkey Drunk drivers are taken 20 miles from town by the police and forced to walk back under escort Norway Three weeks in jail at hard labor, one year loss of license. If the driver commits a second offense within five years, his license is revoked for life. Finland Driver is automatically jailed for one year at hard labor. Sweden Driver is automatically jailed for one year at hard labor. Costa Rica Police remove plates from the offender's vehicle. Russia License revoked for life. England One year license suspension, a $250.00 fine and jail for one year. France Drivers are punished with a three year loss of license, one year in jail, and a $1,000 fine. Poland Jailed and fined and forced to attend political lectures. Bulgaria A second conviction results in execution El Salvador Your first offense is your last, as punishment is execution by firing squad. I kinda like El Salvador's solution.
