BMW transmission issue

True, a great looking car. Possibly now an LSx candidate...

You may be smelling fluid burning on the exhaust, I frequently see overheating 5/7 series transmissions puke fluid from the shifter seal and it ends up on the exhaust.

 

Interesting, How would you be able to tell if this is the case? Would everything have to come apart or is there a better way to tell?

The last one I saw actually popped both shift seals, the shift shaft passes through the trans and protrudes on each side and each seal was un-seated.

 

Get it on a lift, you should be able to see dampness around the seals and typically a trail of fluid aft of the leak source. The worst one I've seen had trans fluid coating everything back to the rear bumper.
