Otis Nice
The one thing I can't seem to figure out from a couple of articles I've read is, Why they can't just shave her head. did she lay it on thick? can't she just wait for her hair to grow out a little or her sink to exfoliate and the stuff will come out? Other than having her hair glued to her head, how is it hurting her? I don't recall if it's in that article in the OP or not but I saw the meme of the before, during, and after. She got scalped basically. I'd look it up for ya but I'm eating lunch right now and this is all the effort I want to put into it currently. Remember, people like this can breed, vote, and drive cars. That should scare you more than anything. I know. I've encountered a few of them in the political threads. :gabe: So if the coffee was standard temp, would she still have had to have skin grafts, probably because at 79 your skin is different than 29. Perhaps, but she would have had more time to react had the coffee been closer to 160 or even 180 degrees. Are you more likely to get severe burns by sitting close to a campfire, your shoestring catching fire, and you having time to stomp it out, or being dowsed in gasoline and set ablaze? Fact of the matter is McD's was negligent and it cost them. They were in the wrong. Imagine defended WackArnold's for being at fault. Otis Nice
Again, asking for a carrier would have made a difference. I can remember people opening the glove compartment, putting the drink on it and doing whatever or even using it as a tray. Better yet, I've put it on the floor between my feet and fix. I guess I was raised to take responsibility for my actions So she gets a carrier and puts it on a glove box and it would never tip. Is that your stance? Take responsibility for your actions, absolutely, but c'mon, man. Read about the case and the studies. Oof.

Geeto67
What point are you making by stating this? That it's okay that she didn't know better? Not at all, but I am not surprised that she didn't. Ever live in Louisiana? It's a wonderful place with it's own really interesting culture but the lack of education is pretty apparent across the board. Things that we take for granted as common sense aren't always common sense down there due to lack of exposure, education, or just poverty. Again, asking for a carrier would have made a difference. Assuming she would have even gotten one, which is slim. And how would a carrier have made a difference anyway? She was parked trying to put cream and sugar in the cup with the lid off, you are saying that somehow balancing a cup in an unstable carrier on her lap is preferrable to holding it with your knees? I can remember people opening the glove compartment, putting the drink on it and doing whatever or even using it as a tray. yeah GM even had cup holder indents in the lid of the glove box in the 1960's. but that was the 1960's, and this was a 1989 ford probe - govebox was more of a basket that came down from the dash than a fold out flat lid. Better yet, I've put it on the floor between my feet and fix. I guess I was raised to take responsibility for my actions Let's say instead of putting coffee in the cup, McDonald's screwed up and put sulfuric acid in the cup, Would you hold McDonald's responsible then? I assume you would say yes since you are a big "personal responsibility" guy and why should Mcdonalds get off the hook. So why does Sulfuric Acid make McDonalds the villian and super heated coffee that nobody is expecting not?

Take responsibility for your actions, absolutely, but c'mon, man. Read about the case and the studies. Oof. If she gets a carrier and she's working the coffee in it, the coffee spills into or on the carrier. Since the car was stopped she could have put the coffee on the glove compartment to work on it. Or as I said on the floor. Why didn't she or the drive just pull over from the drive-thru do what needed to be done and go on...Just sayin' Seems like a lot of moving parts, but it seems the mcd attys were dicks and got called on it
cstmg8
I feel like the glue to the head case is completely different. Can we get some analysis on that one? Hot coffee case had fault on both sides for sure, but what was Gorillas fault on this one?? Did they to clearly mark adhesive on the label?? I speculate that she was hoping to find the next "hot life back" and become instafamous. Lettuce discuss ( and drop the 40 year old case). Mace1647545504
Kerry the whole acid argument is ridiculous...come on dude... Geeto67
Kerry the whole acid argument is ridiculous...come on dude... Is it ridiculous though? Or is this whole thing turn around expectations about liquids in cups? When you ask for coffee..back then..you expected it to be hot..I do not remember anyone drinking or being offered ice coffee. So you answered the question here, it is about expectations. I've spilled coffee on myself at least a dozen times and never once did I need a skin graft, know why? Because the normal temp coffee is served at isn't anywhere near the temp that can cause that. The expectation is that coffee shouldn't give you severe burns in a matter of 7 seconds or less. So if a company is heating coffee beyond what is normally expected why shouldn't they be held responsible? The truth is that you don't have any real knowledge of the circumstances, you don't have any knowledge of how fast hot liquids cause burns, and you refuse to accept that coffee heated beyond what is normal can cause significant injury, and for some reason you have planted your flag in the camp that it is a frivolous suit and refuse to accept any other outcome even in the face of facts to the contrary. greg1647545532
I believe Panduh hasn't thought about the case in 15 years, but there's a reason it keeps coming up. Part of the conservative ethos is this idea that "America is now a bunch of pussies," logic thus dictating that there was a time when we weren't all a bunch of pussies. Men were tough, women wore dresses, and things made a lot more sense. Conservative mouth-breathers on TV like to bring up the McDonalds coffee case because they see it as an example of the pussification of America. "Back in my day, we took personal responsibility for our actions, but nowadays you can sue for millions if you spill coffee on yourself!" Reality, as we can see from this thread and the changing consensus of that case, is never that black and white. But what does that mean for the modern conservative? If the coffee case is muddled, then maybe that era of American lore where men were men and women were women and nobody was pussies wasn't that black and white either (pun intended?). Maybe we've always been pussies and we just never knew the truth. People like Mace have to stick to their story here because not doing so would chip away at their whole worldview. Also, FUCK SPRING, CR POLITICAL THREADS FOREVER!!!!

Geeto67
I guess because they both have "glue" in the name? Actually there are a lot of glues that get used in Hair, bonding glues for hair extensions, homemade solutions for keeping hair in a specific shape, professional hair sprays, etc... When I was 15 I had a fan style mohawk for a brief period and I used everything from egg whites and boiled sugar to watered down elmers white glue to hold it up. Some of these home remedies were groce (drying egg whites smell awful in summer). I can't speak to black culture and the practice of "gluing hair down" like a lot of women do, but glue probably figures into it somehow. If I had to guess, she probably didn't have much experience with gorilla glue and it wouldn't be unreasonable to think it was similar to Elmer's glue given the packaging (bright colors, animal mascot, similar shaped containers) I don't see her having a case. Probably not but hard to say with what details are out there now. If in the past gorilla glue ever embraced it's use as say a method of attaching hair extensions, then there may be something to latch on to. I will say, I am impressed at Gorilla Glue's response - most companies would point to their warning label and then walk away from the whole situation, but they offered some assistance in her trying to get her hair unstuck. Lets see how this plays out.
Mace1647545504
and greg has pushed it political ...just so you know or like I said before back in the day I was ignorant and voted straight dem...so your argument or lack there of holds no water..or coffee. Back then I thought it was dumb and I still do. And yes I will agree with you. America has become more pussified than when I was a kid. Kerry you are correct I do not know at what temps you have time to get out of harms way to avoid serious burns. I as I said I have put stuff between my feet on the floor to make a drink. Kerry..I would love to see you with a mohawk..back in the day my mom and then wife talked me into perming my hair..I have a pic with permed hair and a porn stash. Geeto67
And yes I will agree with you. America has become more pussified than when I was a kid. I don't buy it. If anything I think American values have become stronger as we move more and more toward doing the right thing and taking care of each other. Just to tie this to cars - when someone brings up the "back in my day" pusification argument I think of Von Dutch the pinstriper. He was the epitome of "tough" in hot rodding - always picking fights, riding around on an old Indian, telling his customers to fuck off regularly, Hung out with Steve McQueen (another "tough guy who beat everything he was married to). You didn't fuck with Von Dutch. Except he was a Neo Nazi by his own admission, and a raging alcoholic, and many who met him believed he was undiagnosed schizophrenic. The same "friends" who loved his work and marveled at his art were always relieved when he didn't show up to their parties. He died from complications of alcoholism, a hermit, living in a converted Bus on someone else's land. William Burroughs, author of naked lunch, was a lot like that as well, dressed sometimes like a cowboy and sometimes like a 30's gangster and collected a shitload of guns. He also shot his girlfriend between the eyes in Mexico while trying to drunkenly play William Tell. If that is what "back in my day tough" is, being an unabashed bigot, raging self medicating junkie, and an violent anti-social mentally ill person, you can have it. Truth is, pusification is a made up thing to sell you crap like axe body spray and 5 blade shaving razors and to get you to go along with outdated political policies like not paying for public education. It has no intrinsic value other than to falsely reinforce a bunch of insecure people that empathy is bad and every dispute should be solved with a punch or not at all. As society progresses, it always improves. Kerry you are correct I do not know at what temps you have time to get out of harms way to avoid serious burns. I as I said I have put stuff between my feet on the floor to make a drink. Otis Nice
If she gets a carrier and she's working the coffee in it, the coffee spills into or on the carrier. Ah, yes. The all new Weathertech Beverage Carrier. C'mon, man. Surely you've used one of those. They literally have holes all through them and are cardboard. You so silly. I feel like the glue to the head case is completely different. Can we get some analysis on that one? I believe that's exactly what some of us are saying. McD's was clearly negligent. GG was not. Mace1647545504
I guess when I think of pussification..back in my day if you had a beef with someone..you squared off and duked it out. Today you get shot or stabbed. Look at the numbers today, they are ridiculous. And the softening, if you play sports everyone gets a trophy and don't keep score because if you lose you may hurt Johnnies or Mary's feelings...we are all winners. Sorry, no we all aren't. So when my feelings get hurt I can't take it and I then either shot you and or me. And it's funny you talk about Von Dutch, I was just reading an article in R&T. Mensan
I do not know at what temps you have time to get out of harms way to avoid serious burns. At 190, the temperature it was being served at, it removes flesh from bone within 2-7 seconds. They have since modified the temperature at that location to 158 degrees, which is still damn hot. Over 700 people had been burned and there were internal communications at McDonald's that stated they knew the risks of coffee that hot. It's absolute criminal negligence at that point. The woman did not sue to get any money for herself, she only asked for her medical bills to be covered. The jury awarded her punitive damages on their own due to the severity of the negligence in this case.
