43. Took my first ride on a buddies old beat up Honda in '87 and bought my first bike in '95. '79 KZ750 LTD for $200.00 rear tire and engine on the frame, the rest was in a box. Put it together and got it running and registered in '96.

4511.28 Overtaking and passing upon the right of another vehicle. (A) The driver of a vehicle or trackless trolley may overtake and pass upon the right of another vehicle or trackless trolley only under the following conditions: (1) When the vehicle or trackless trolley overtaken is making or about to make a left turn; (2) Upon a roadway with unobstructed pavement of sufficient width for two or more lines of vehicles moving lawfully in the direction being traveled by the overtaking vehicle. (B) The driver of a vehicle or trackless trolley may overtake and pass another vehicle or trackless trolley only under conditions permitting such movement in safety. The movement shall not be made by driving off the roadway. 4511.42 Right-of-way rule when turning left. (A) The operator of a vehicle, streetcar, or trackless trolley intending to turn to the left within an intersection or into an alley, private road, or driveway shall yield the right of way to any vehicle, streetcar, or trackless trolley approaching from the opposite direction, whenever the approaching vehicle, streetcar, or trackless trolley is within the intersection or so close to the intersection, alley, private road, or driveway as to constitute an immediate hazard.

I understand what you're saying and your point of view. Rather than compare apples to oranges, I'd rather attempt to deal with this particular situation for what it is. In reading the PA code, an informed LEO in Philadelphia would have reason to question the open carry of a citizen. In Ohio, an informed LEO would have to approach this particular scenario differently. How it would be approached depends on the LEO, the citizen open carrying and the circumstances surrounding the encounter. -

It's not meant to be complicated, although it's amazing how quickly it can become that way. If the person walking down the street with a visible holstered firearm is a felon or a person declared by the courts to not own or possess a firearm, he should not be openly carrying a firearm. This particular individual has lost his 2nd Amendment rights. -

This is interesting: 18 Pa.C.S. § 6108: Carrying firearms on public streets or public property in Philadelphia No person shall carry a firearm, rifle or shotgun at any time upon the public streets or upon any public property in a city of the first class unless: (1) such person is licensed to carry a firearm; or (2) such person is exempt from licensing under section 6106 of this title (relating to firearms not to be carried without a license). The LEO appears to have the right to question this individual whether he is licensed to openly carry in Philadelphia. By identifying him, you may find out if he's even allowed to possess a firearm. With 24 police officer deaths as a result of gunfire, to this date, in 2011, I believe LEO's should approach any gun call with extreme caution. Until I know that this person openly carrying is legal to do so, I would remove, disable and secure the firearm. Once everything checks OK, I'll return his firearm and he can go about his day. Just because you see an individual exercising his 2nd Amendment right, doesn't necessarily mean he's legally allowed to do so. -

As per Ohio law, the check points were announced earlier that day. Anyone not wishing to be "inconvenienced" by the check points should have considered an alternate route. A well informed, sober driver would have avoided a check point. Sobriety checkpoints set for Hilliard area tonight Thursday, March 17, 2011 11:23 AM The Columbus Dispatch Two sobriety checkpoints will be set up tonight in the Hilliard area. The Franklin County DUI Task Force will be checking drivers on Cemetery Road east of Leap Road. The Columbus Division of Police will be doing the same on Hilliard-Rome Road south of Roberts Road. The checkpoints are scheduled to begin at 9 p.m. and to continue until about 3 a.m. The Task Force reminds people who will be drinking alcohol to arrange for a ride home with someone who has not been drinking. -
4503.21 Display of license plates and validation stickers or temporary license placard or windshield sticker. (A) No person who is the owner or operator of a motor vehicle shall fail to display in plain view on the front and rear of the motor vehicle the distinctive number and registration mark, including any county identification sticker and any validation sticker issued under sections 4503.19 and 4503.191 of the Revised Code, furnished by the director of public safety, except that a manufacturer of motor vehicles or dealer therein, the holder of an in transit permit, and the owner or operator of a motorcycle, motorized bicycle, manufactured home, mobile home, trailer, or semitrailer shall display on the rear only. A motor vehicle that is issued two license plates shall display the validation sticker only on the rear license plate, except that a commercial tractor that does not receive an apportioned license plate under the international registration plan shall display the validation sticker on the front of the commercial tractor. An apportioned vehicle receiving an apportioned license plate under the international registration plan shall display the license plate only on the front of a commercial tractor and on the rear of all other vehicles. All license plates shall be securely fastened so as not to swing, and shall not be covered by any material that obstructs their visibility. No person to whom a temporary license placard or windshield sticker has been issued for the use of a motor vehicle under section 4503.182 of the Revised Code, and no operator of that motor vehicle, shall fail to display the temporary license placard in plain view from the rear of the vehicle either in the rear window or on an external rear surface of the motor vehicle, or fail to display the windshield sticker in plain view on the rear window of the motor vehicle. No temporary license placard or windshield sticker shall be covered by any material that obstructs its visibility. (B) Whoever violates this section is guilty of a minor misdemeanor. If the citation was for failure to display then you may not win this in court. If you were cited for expired plates/registration and have the paperwork to prove valid registration then fight it. Like the press release states, "contact Georgia Gov. Nathan Deal to urge him to stop the Georgia State Patrol from conducting any motorcycle-only traffic checkpoints." Let him know that you won't travel into Georgia. Remind him you can travel around the State of Georgia and spend your dollars in Alabama and most of South Carolina. When the business' start seeing their summer revenue take a dive, they'll let the GA governor know too. -
FOR IMMEDIATE RELEASE Riders asked to oppose Georgia motorcycle-only checkpoints February 23, 2011 The American Motorcyclist Association (AMA) is urging riders nationwide to contact Georgia Gov. Nathan Deal to urge him to stop the Georgia State Patrol from conducting any motorcycle-only traffic checkpoints. Tens of thousands of motorcyclists from around the nation could be subject to Georgia motorcycle-only checkpoints if those checkpoints are in place before, during and after Daytona (Fla.) Bike Week, which runs March 4-13. Ed Moreland, AMA senior vice president for government affairs, suggests that riders contact the governor through the AMA website at http://www.americanmotorcyclist.com/rights/issueslegislation and ask that any motorcycle-only checkpoints be suspended until key questions are answered. Those questions, which have been posed by the AMA to Deal and other officials, include: How do motorcycle-only checkpoints increase the safety of motorcyclists? Where do states draw their authority to conduct motorcycle-only checkpoints? Is "probable cause" required to stop a motorcycle and, if so, what constitutes probable cause? The National Highway Traffic Safety Administration (NHTSA) gave Georgia a $70,000 grant to conduct one or more roadside motorcycle-only checkpoints. New York state has operated a similar program. The AMA has been tracking this disturbing development of motorcycle-only checkpoints since it first appeared in New York several years ago. "The AMA believes that the primary source of motorcycle safety is in motorcycle crash prevention and not in arbitrarily pulling over riders and randomly subjecting them to roadside inspections," Moreland said. "The NHTSA should focus on decreasing the likelihood of crashes from occurring in the first place," Moreland said. "No public money should be applied to promoting such a program without first addressing questions from the motorcycling community," he said. In addition to letters submitted to the past and present governors of Georgia, the AMA has questioned the potential discriminatory and legal nature of this program and submitted a list of questions for clarification to the New York State Police concerning that agency's program. The AMA also sent a letter to NHTSA Administrator David Strickland urging him to suspend the grant program that gives states money for motorcycle-only checkpoints until questions have been addressed.
