no it isnt. if that is the case, you will get stopped currently also (it has happened to me). the new law in question (that sapphy suggested about retaking the test) will not change that at all. -

License status is tied to plate...you wouldnt be "randomly" pulled over, cops are so lazy about that shit now they use scanners to check plates - if the plates are valid, nobody cares about pulling you over to check the driver status - unless given another reason to....you know, pretty much the same as it is now -

i had a gas station employee tell me im not allowed to carry in there (was OC at the time) because they sell alcohol....1. it wasnt selling for consumption, so pre oct 1st i was allowed, and 2. the incident was a few weeks ago - im allowed to carry in a damn bar, let alone a gas station lol

there just needs to be a law that if youre a fucking idiot you get a ticket....seems legit to me, second or third offense you get sent to a "camp"...i think im onto something -

so youre suggesting the ban of handsfree devices also? some of you people dont live in reality...im completely shocked and for the record - new cars have a lot of cell phone features built in where they have a mic and speakers and you can make and take calls through the car stereo without your hands leaving the wheel or your eyes leaving the road....if they were trying to jam cell signals, i doubt major auto companies would continue to waste resources on these features -

there is a huge grey area, you just refuse to see it because youre set in your opinion. how to prove if the call was an emergency? who decides what constitutes as an "emergency"? (see my earlier example) what if a phone call comes in that you take on a handsfree head set and immediately after the call youre in an accident, the phone record would show you on the phone at the time of the accident. what is the difference between looking at your phone to see who is calling, and using the phone? you have to look at the callerID, same as you would look down to look at a txt, change the radio, etc what if a person claims to have been using talk-to-txt, or speaker phone which is also hands free...how would it be proven they are lying? lock them up anyways, right? i could go on and on about circumstances that are not cookie cutter perfect situations that fit your mold -

also like stated above - who is to dictate "emergency"? my fiances car busted a ball joint in the fucking ghetto of columbus....she was sitting there in a car that doesnt lock, with no means to defend herself, in a very bad area of town, at 11pm (driving home from her job)....is that an emergency in itself? no, its a broke down car. does it have potential to get very ugly, very fast? fuck yes it does. and that is an emergency to me. ^^ THIS is my point -

exactly - im not against a ban - but theres just so much gray area on proving that an offense has taken place, that enforcing such life altering penalties doesnt seem right. people who drive for a living would automatically be out of work. 6pts on your record and a company will drop your ass because their insurance wont have you. some people dont understand how much a DUI can ruin a persons life and livelyhood (as i believe it should in the case of a DUI), but to enforce those type of penalties on an "assumption" or on "probably cause to suspect" is bullshit -

txting and phone calls are being rolled into the same category with this law - what about my example about the phone call? if you get a phone call from your kid or your wife, wouldnt you answer it? i would. you never know when it will be an emergency. and if its not that time, should you still receive impound, 6pts, 1yr license suspension, two nights at a txting rehab program, and a "small (pay for court costs, 2 day program, attorney to not get fucked, license reinstatement, ticket, and the fine itself...well over a grand total)" fine? -

thats what i do also. good to know its not illegal, not that it matters too much, just nice to know one less thing is illegal...seems like theres so many traffic laws that make no sense already lol, like how my neighborhood exit is a stop sign, and the one across from me that is identical to my exit, is a yield sign....i got a ticket for running the stop sign, but if i was on the other side, pulling onto the same road, from an identical exit way, i would be ok -

if the penalties were as strict as DUI requiring a court appearance - i assume they would subpoena cell phone companies for phone records to prove their case if it was a slap on the wrist fine, they probably dont need proof and if you want to contest it in court bring your cell phone records that show you werent on the phone at the time of the stop i know thats how they bust people for txting while driving in the case of serious accidents -

6pt ticket, license suspension, huge fines, jail time.....for answering a phone call? really? whats next, felony charges for changing a radio station while driving? (for people without steering wheel controls)....there are plenty of things more distracting than answering a phone call, a DUI is from the second you get in the car to when you exit the car, very different than taking 30 seconds to answer a phone call.....and who is to judge if its an emergency? what if your wife calls you - you wont answer because its illegal, what if she needs help? or got injured or something? wouldnt you want to know right away....then if you answer to check, what if she is calling to ask what you want for dinner? you answered thinking it could be an emergency, when actually it isnt...now you deserve DUI type fines? theres way too much gray area in this law to enforce such strict penalties -
