No people are just confused. They are paid hourly above standard minimum wage, which means they are not entitled to any tips. They can "Pool, share or split" tips in any way, as long as the servers hit the $7.80 minimum wage. If Samy takes all the tips, but pays them $8/hr, it's legal.

How can the statute of limitations pass on something that was never valid in the first place?
