hahahahahah... oh wait... you're serious. let me laugh even harder. i honestly do not see how a reasonable person could watch that video and conclude that the police were in any danger whatsoever. maybe if everyone in the crowd had a bat and helmet... either you are just trolling, or are just a toadie...

the first thing is to stop setting the speed limits artificially low as a means of revenue generation. then we can talk about changing penalties.
-
i understand what you're saying... it would all really depend on exactly how the law was worded... the law doesnt even exist, so its all hypothetical at this point, and im sure these kind of issues would be brought up. if the law was written to say its illegal to use a handheld cell phone (or any electronic device with a display... this covers your ipod too) in any capacity while driving, then it doesnt matter if you're texting, looking up a number, calling your gf, or posting to FB... if you're doing it while you're driving then you are in violation.

yeah, i drive fine when im drunk... just because some dumbass drank too much and ran over a kid, why shouldnt i be able to tie one on and drive around?
-
yes. when you hover your mouse over it, it brings up an X in the upper corner. if you click it, you shouldnt see them again.

all OVI involves officer judgement. its the officers opinion that you are drunk, until you take the breathalyzer and it shows you are over the limit. im not sure about the blood test for drugs either... but that can bring up its own issues, mainly that drugs can stay in your system for days or even weeks depending on what it is, so it doesnt mean that you are under the influence of them at the moment you are being tested. if i took whatever on saturday, then get pulled over the next wednesday, there may be evidence of them in my system still, but clearly im not still under the influence of them 4 days later. so what are we saying here? that there shouldn't be a penalty because there are many other ways you can kill someone driving? im not clear.
-
there is a glaring problem with that idea though...
-
OVI is not just as simple as over/under end of story. you can still get a blow under the limit and get charged if the cop thinks that you are too impaired to drive. OVI is not restricted to alcohol either it counts drugs also... so i could take 5 xanax, drink a beer and then get pulled over. i wont blow over .08, but im def gonna be crunk out on pills, and can still be charged with OVI if the cop thinks im too impaired to drive.
-
yep. studies show that someone texting and driving is MORE imparied than someone at the legal limit... so either the penalty for texting and driving should be 6 months, 1000 dollars and loss of license etc everything else you get with a DUI or a DUI should be 150 bucks, heres your ticket and you're on your way.

id think the majority of protests are peaceful. further, they should be immediately suspect of anyone who is advocating or trying to incite violence. there is a good chance that they are working with the authorities, or are police officers themselves. aka agent provocateurs. this has happened all over the world, including in the US and Canada, and has been well documented. for example: http://www.youtube.com/watch?v=St1-WTc1kow or in denver during the DNC, when police officers went undercoveras protesters, incited violence, and ended up getting pepper sprayed by uniformed officers.
-
so just in general, can you yourself, as an officer, say you were offended and be the complainant for this, or would a citizen have to come up and say that they were offended before you could act? and i would think you'd have to witness the act occur too right?
-
im sure they expect to be arrested, and thats all well and good... i mean, thats kinda the point isnt it? i mean, its not much of a protest if the cops say leave, and they all just say okay, sorry. but that still does not change the fact that it has already been ruled that pepper spraying non violent passive resisters constitutes excessive force.
-
i dont really see how anyone could watch that video and reasonably conclude the police were in any danger or feared for their safety in any way. maybe if the protesters all had bats or something, that would make sense then... but that was clearly not the case. the courts have already ruled that using pepper spray against non violent protesters is excessive, and this video does not change that. http://archive.ca9.uscourts.gov/ca9/newopinions.nsf/4AABD133965012F888256B3D0083536D/$file/9817250.pdf the use of pepper spray on the protestors' eyes and faces was plainly in excess of the force necessary under the circumstances, and no reasonable officer could have concluded otherwise. actually, there are three. there's your side, my side and then there is the truth, which lies somewhere in the middle.

the thing is, a beginner doesnt HAVE a decent head on their shoulders. they dont have any experience. they dont know what they are doing, and they dont know how to listen to the bike, or what the bike is telling them. hell, its common for a noob to drop their bike at a walking pace or standstill, let alone at a street pace or faster. many of these supersports will not tolerate incompetence. its very easy to get in over your head because the bike is not forgiving, and the new rider doesnt know when the bike is saying "hey you're about to get in over your head". you can say "oh yeah just be careful" but as a beginner, you really dont even know HOW to be careful, because you dont really know anything at all. thats why you're a beginner. an inexperienced rider can get into just as much trouble on a buell blast as they can on a supersport. one just gets them into trouble a lot faster. one is much less forgiving of mistakes, and more tolerant of incompetence (which a newbie has in spades). if your kid had never driven before, would you just toss him the keys to your vette and tell him "you've got a good head on your shoulders. just be careful"? sure, there are people who started on supersports who are fine. there are a bunch that wrecked the bike and never got back on, and there are a bunch that are hobbled for life or dead too. the fact is that supersports are not beginner bikes period. they are, by design, for experienced riders. the purpose of your first bike should be to allow you to master riding skills and build confidence. you dont grow into a bike, you develop your skills on it. im not trying to be buzz killington here, i just dont wanna see someone get in over their heads and get injured or worse.
