I need the tint redone on the M3 and don't want to get hassled when I drive thru Westerville all the time. It's bad enough not having a front plate. 35% will likely be safe. I've run 35% on all my cars for years and haven't really been bothered. It varies car to car, and interior to interior but most can't pick 35% from 50% consistently.
