It's similar to states that sell Marijuana tax stamps but keep it illegal...Or US tax law, you have to declare value on anything you've stolen (unless you returned it that year).When the state looks to levy charges they look for everything they can to keep bumping up the charges and penalties. 5th ammendment will win if it ever went to court.
