New details emerge: http://www.cnn.com/2012/05/16/justice/florida-teen-shooting/index.html?hpt=hp_t2 - George Zimmerman's medical report states that he had a closed fracture of his nose, two black eyes and two lacerations on the back of his head. Zimmerman's side said this backs up the "Second Confrontation" theory. Martin's side points out that the injuries were not bad enough for EMS to transport him to the hospital. (Who would go to the hospital with black eyes? The lacerations apparently needed no stitches. No word on if the broken nose needed surgery) - Martin's autopsy shows he had knuckle injuries consistent with fighting. Zimmerman's side says this is consistent with Zimmerman's version of events. Martin's side said we should not forget that Zimmerman starting this whole thing by following Martin. (Is that an implicit acknowledgement that Martin *did* attack Zimmerman in response to being followed?)
  3. Unless that bike ahead was a cop, I'd have given them a couple minutes to complete the pass or punch right through. 40 minutes? 40mph? No thanks. If I was in a car I'd pass on the shoulder then slow the slow-lane truck down to break up the clog.

  7. I'd say Assault (2903.13 I think) is a good match. Specifically section B. Section A states the person must "knowingly" cause or attempt to cause harm. So I say section B, "No person shall recklessly cause serious physical harm to another". But that's a Felony 4 or 5. Does not require intent, but does require the prosecutor prove recklessness (that is, the guy knew of the risk of harm but did it anyway) Failing that I'd try for Negligent Assault, Misdemeanor 3. (2903.14 I think) "No person shall, using a deadly weapon or dangerous ordnance, negligently cause physical harm to another..." I can't believe a jury would think a shotgun, even shooting a shell with the pellets removed, into someone's mouth is NOT a deadly weapon or dangerous ordnance. It requires no proof of intent either, instead it only requires that the prosecutor show negligence (that the guy failed to recognized the risk, but a normal person *would* have) I'd prefer the felony conviction, though, to put him under weapons disability.

    Bird crapped on my bike yesterday. Bird. Crapped. On my bike. Landed on my windshield. Like about tablespoon of McDonalds vanilla mikshake with a pea-sized piece of heaven right in the middle. If I was one foot further down the road it would have got me in the helmet. Bugs? Nothing. Rocks? Hah. Ballistic Birdshit? Hardcore. Still wanna skip the eye protection?

    The bed floor had ridges no? Strap it down with the forks compressed about halfway, then add an extra couple straps low around the bottom edge of the wheel if you are nervous - then the front wheel will no slide out sideways.

    Confused... Oh, I misread that post - I thought it said BMW motorcycle manual. I was making the point that a company's lawyers will always err on the side of not getting sued. We agree on the basic issue, I just read BMV as BMW.
  22. Getting real close to that wear block. The tread is about 1mm deeper than the wear block. Got a little over 6k miles on these. Front and back both worn about the same.

    From a liability perspective, the lawyers will tell you you need seperate eye protection from the windshield. If the lawyers had their way they would require windshielf, visor AND goggles. Cub Cadet's lawyers tell you not to mow your lawn when children are present, but the law does not say that. Legally, the sticking point is "what constitutes an effective windshield".

    ORC 4511.53(B) states that all motorcyclists must wear eye protection while operating the motorcycle (which includes stopped at red lights). The eye protective device must conform to OAC 4501-17-04. (Ohio Administrative Code) Incidentally, I read this as "If you flip up your visor at a red light, then as long as you have a full size windshield then you're still considered to be using an approved protective eye protection device." Hmm... What type of bike was the OP on? Did it have full windshield? Or a tiny ineffective windshield. If a full windshield that comes up to next height while seated normally then that could be a defense to the ticket that I'm assuming he got based upon how much me whined and cried like a 5yo having a tantrum.
