  3. I know that a police officer ha the authority to direct traffic, even against traffic signs. Accident scenes, etc. But here's the situation. I work at a company that often hosts evens for members of the public. On these days the roads leading to the parking lot are busy. They usually have a security guard standing in the 4-way stop directing traffic (mostly to let visitors know where to go). He will wave people to continue through the stop sign without stopping and will yell at you if you stop at the stop sign (as required by law). So, take this is a legal thought experiment, not a "I don't know what to do" kind of thing... If there is an accident as a result of one car being waved through the stop sign without stopping and another car that doesn't realize traffic is being directed... Who is at fault? I believe that a civilian cannot override the stop sign and, just like when "someone waves you out", the ultimate responsibility to comply with traffic laws is on you. If you are waved through the stop sign and hit another car who was expecting you to stop, then YOU are at fault. The guy directing traffic is the reason for the accident, but not an excuse.

If someone waves me out and I hit a 3rd party then I'm at fault - but if someone waves me out and THEY subsequently hit me (and I can prove they waved me out) then I believe they should be held liable. Of course then you get into the whole "I was flashing my lights to warn you, not let you out" or "I wasn't waving you out, I was telling you to stop" ugliness.
  5. British drivers do a better job of sharing to road out of necessity. Vehicles park by the side of small roads and people MUST drive in a co-operative manner or there's be gridlock. US drivers (myself included) have developed a "THIS LANE IS MINE!" attitude and balk at sharing. We need to get past that before we can have bikes filtering.

    That thing is not going to go missing. It's attached using multiple thick 3" long screws into a wooden post that is supporting my porch. You'd be quicker to cut down the porch support.
  10. Called verizon one time because the SD slot in my phone quit working. I'm a DBA so I know computers. 1st tier support wouldn't pass me on without going through their checklist. Verizon: "Hello this is Naveen. What can I help you with today?" Me: "The SD card slot on my droid x is not working. Have done all the usual tier 1 troubleshooting. Can I have next tier support please?" Verizon: "Have you tried turning the phone on and off?" Me: "Yes. Can I have next tier support please?" Verizon: "Have you tried taking the battery out for 60 seconds?" Me: "Yes. Can I have next tier support please?" Verizon: "Have you tried reprogramming the roaming profile?" Me: "No, this is an SD card slot that is bad - it's all over the internet, it's a known problem. Can I have next tier support please?" Verizon: "Please dial .... to update your roaming..." Me: "Sigh." (updates roaming) Verizon: "Did that fix your problem?" Me: "No, and I'm not at all surprised. Can I have next tier support please?" Verizon: "Have you tried a different SD card" Me: "Yes. And I have tried this SD card in my computer and it works fine. Can I have next tier support please?" Verizon: "I'm going to need to have you turn your phone off and on again." Me: "That's a waste of time. Can I have next tier support please?" Verizon: "Please, reboot the phone." Me: "Sigh." (reboots) "Did that fix the issue?" Me: "NO. It won't It's a physical problem. Can I have next tier support please?" Verizon: "I need you to take the battery out for 60 seconds." Me: "Why? It's a physical problem. I've done that already, didn't help. Can I have next tier support please?" Verizon: "Please take the battery out for 60 seconds" Me: "Sigh" (takes battery out) Verizon: "Did that fix your problem?" Me: "Yes." Verizon: "Really?" Me: "NO. IT DIDN'T. IT WON'T. NEXT TIER SUPPORT PLEASE!!" Verizon: "I am unable to help you, so I will transfer you to next tier support." Me: "Hallelujah!" Verizon: "Hello, this is John. What can I help you with." Me: "My droid x SD card slot is dead. I tried rebooting the phone, taking the battery out and all the usual stuff. Tried re-seating the SD card, no help. Took the SD card out and it works fine in my computer. I tried another known good SD card in there and it didn't work." Verizon: "We'll send you a new phone."
  11. I've been served subpoenas from Municpal and Common Pleas courts. The Common Pleas court served me in person via a Deputy to my house and I had to sign to say I'd been served. The municipal court just sent be the subpoena in the mail, not even registered. If service is in person then I'm guessing it's a common pleas case...

  13. What is a typical sentence in this kind of case? They may have used the "not used to drink" excuse in mitigation but that doesn't mean the judge used that information in his judgement. The mitigation used was; "not accustomed to alcohol", not "because they are muslim". It's been spun to make it about muslims. You can say anything you want in mitigation. I can offer; "My underpants were green that day..." as mitigation. And I might go free due to the totality of all factors in the case. And it may even be reported; "Criminal goes free after telling judge he was wearing green underpants". Doesn't mean the green pants had any bearing. Still, stupid excuse either way.

  15. Boat ROW rules are weird and not as well defined as road rules. Depending on the type of vessels you can have a situation where one rule gives YOU right of way, whereas another rule gives THEM right of way. None of that matters though - this was a clear day and they both had plenty time to avoid that collision.
  16. ^^ Those SD cards are usually FAT32. Not truly deleted until the dead space is overwritten. As long as the allocation units were contiguous you can get the whole file back. EVen then, individual allocation units can be converted back to files to reveal jpg images (well, depending on the size of the allocation unit & jpg image). And for a video, all they need is a single keyframe.

  21. It was a joke by the staff in response to a register that was unable to scan the fruit. Asda is owned by Walmart. The staff were probably making the same point that we do here - where does the baby-proofing stop?
