Instead of citing him for both (which was what he is expected to do) the officer chose to cite him only for the lesser offense. The only way your buddy could have got off lighter that that would be if the police simply stopped enforcing the law. So, is your buddy upset that his attempt to lie to the cop by pretending he was wearing the belt all along didn't work? If he has a valid reason for not wearing the belt then he should consult an attorney to see if there is some kind of waiver that he can get.

I've seen people cited and listed at fault on accident resports where no contact was made. The at-fault driver will try to claim you over-reacted.

Until Trump drops this birth certificate nonesense nobody can take him seriously. He's splitting hairs between a "Birth Certificate" and a "Certificate of Live Birth". My understanding is that Hawaii ONLY does "Certificate of Live Birth", not a document called "Birth Certificate". And whereas the COLB *can* be issued to somewhere born elsewhere to at least one citizen parent, it *does* list the location of said birth. Hawaii. If the Republicans had proof that Obama was ineligible then they'd say something, right?

I'm a nervous tower. Last time I towed a bike was only 3 weeks ago, and that was in a u-haul trailer with 5 ratchet straps and I was still nervous! I don't like this design, doesn't look strong enough to stop the bike tipping over.

This just in: The accident report does not yet list any offenses charged or who was at fault, however it DOES show that the driver of the car AND the driver of the car tht was behind her BOTH stated that the car had a green left turn arrow and that the bike ran the red light.

I heard that iPhones did a VERY GOOD JOB of tracking you. http://www.guardian.co.uk/technology/2011/apr/20/iphone-tracking-prompts-privacy-fears My GPS is very accurate on speed, but lags by about 2 seconds. The dashcam speed is very accurate, according to mile markers and roadside "YOUR SPEED = " signs.

The Cali and Ohio cases had totally different outcomes because they were presented totally differently. In Cali, the GPS was not the reason the ticket was thrown out. The ticket went away because the officer was ill-prepared and did not mount a solid enough prosecution. The GPS was interesting, but the case would liekly have gone the same way without GPS. In Ohio the guy just tol the court; "I have a GPS and it said I was going slow." The court will not accept evidence without someone being there to testify as to the accuracy. If you submit a video into evidence you must be present to swear on oath that the video is a true and accurate depiction of the events. You also need to be prepared to testify about the chain of custody of the video and swear on oath that nobody else had the opportunity to tamper with the video. I have had to do this myself in court. You cannot submit an anonmyous video and expect it to be believed. Same withthe GPS track - it takes a speed every 2 minutes. That doe snot prove that he didn't boot it up to 84 mph, then slow down again. I'd bet that the 50mph average came from 1:30 of doing 80-90mph then 30 seconds waiting on the side of the road for the cop to approach. I always wondered how my dashcam would work out in that situation. It provides 3 different ways of identifying the speed. 1) Measure the time and distance between landmarks. 2) Measure the distance between the GPS co-ords that are overlayed on the video image and cannot be changed once recored. and 3) The speed is overlayed on the video image too, but in knots. Knots * 1.151 = mph. The video image is saved out in a proprietary codec that I cannot update. I also use a GPS bug for theft-recovery in my car and on my bike. It updates my position and speed every 5 seconds to a 3rd party website which allows me to download a file with the data on it. I bet I could also have the tracking company produce a notarized affadavit stating what my location and speed was at a given time. You'll never take me alive, coppah!

None of this will matter when we stop communicating in sentences. I was in the store the other day and I saw two young teens (brother & sister?) arguing. As the girl walked away the boy smacked her on the butt, kinda like a towel flick but with the back of his hand... It must have stung - she was livid... "I as *SO* telling Dad!! Look, I'm texting him now..."

The officer was not meting out punishment (officially... unofficially you can make your own mind up), he was gaining control of the subject to effect a lawful arrest. Either he gets thrown to the ground, or they sort it out with a stand-up fist fight. The fistfight will do more damage. Getting arrested is not an exercise in sportmanship. Resisting hurts. Of the "brutality" cases out there, the overwhelming majority started with resistance. There *are* examples of horrific police brutality out there (Google John McKenna University Maryland Beating), but this is not one of them.

The only problem I have with this arrest is that it took them too long. Get in there and get it done. Gave the crowd too much time to get worked up. Knee strike? No problem. It's a non-lethal pain compliance technique. Don't resist arrest. Even if you don't agree with or don't understand the arrest, comply and sort it out later. You may win in court, but you will always lose in the street. If the guy wasn't so drugged out he'd have noticed the officers putting on the nitrile gloves. = Party Time in T-minus 10, 9, 8...

To be clear: I don't agree with stops that don't have probable cause. I never said I agree with non-PC stops. Just because I said it happens doesn't mean I find it acceptable, and I never said I find it acceptable. - If I told you that people drive DUI regularly then I'm not saying I agree with it - just stating a fact. - If I told you that some mean beat their wives then I'm not saying I agree with it, etc. I once was pulled over because I "looked scared" when I saw the cop. Cha-ching! "No insurance" ticket. Was "looking scared" PC for a stop? Should I have been stopped? Could I have fought it?

Well that there proves to me you've not been paying attention. If I said a stop without probable cause was acceptable then please quote me. I'll wait. I was trying to explain why an officer would say one thing about the reason for the stop but the actual reason is something else. But at the end of the day there has to BE a reason that would survive a defense challenge.
