The details make the story without them its a different story and people are forced to come to conclusions. First you stated she sprayed him in the car then after i mentioned that it was assault unless the guy was coming out of the car you changed the story to him coming out. The first story was written as he was sprayed for saying f u to them. The second was written to fit him being sprayed for being assaultive. Seems to me you changed your story to make it better.

It was pretty much guy about hit bike biker yelled at him guy said f you and lady sprayed him Also bikers often make the mistake that people see them which often isn't the case. How do you know he actually saw you guys? You did say he was distracted.

Different story posted here. You never said he purposely did it or mentioned him making any threat or getting out of the car. So which story is accurate?

I was referring to you saying she was justified in using OC or whatever it was because the car was deadly force. Now the OP added to the story and stated tge guy put his car in park but is still leaving details out so its hard to say but i would have to say her spraying him is assault until the guy grabs a weapon that he can harm them with from inside the car at that moment or he exits the vehicle and comes at them in a manner that a reasonable would see as threatening. Until something like that happens she's the one being assaultive. If something like what i mentioned above happened she is reacting defensively. It doesn't matter what is said mean words don't justify harming someone. If you want to say she was justified when he put the car in park does that mean she could spray the OP also because he put his kickstand down?

Are you saying legally you think that was ok? Are you saying that you feel there isn't a greater risk to the other motorists if he was sprayed with OC? Are you saying that they didn't go from an argument to a fight at that point? Those are the only points I'm making. As current federal law enforcement I know that because my personal opinion is someone got what they deserved I can't ignore the law and say its not assault if I'm called in.

Even if its a glass of water at room temperature that's still assault and turning the argument into a fight. It was a completely different tune in the thread where the ex-osu football player was shooting his gun at the guy in Delaware.

If it was OC what about all the other traffic on the road that now has to deal with this guy? Some people freak out if they get sprayed. If that guy is one of those people that makes him even more dangerous to everyone including the couple on the goldwing. Driving like a jack ass isn't a good reason to get yourself an assault charge.

My grand father was a WWII vet. He was in the 82nd Airborne. When my dad was a kid they lived beside a small lake that was pretty much the neighborhood public pool. I guess one day my grand father saw the grounds keeper for the lake trimming the bushes that ran along the property line and he was wearing a Nazi helmet. So my grandfather put on his uniform and walked up to the bushes and pointedhis .45 at the guys head. He told him something along the lines of "I killed several Nazis during the war I don't have a problem doing it now. Take the helmet off or I'm going to shoot it off your head." The grounds keeper took the helmet off then went and called the cops. They showed up and asked my grandfather for his side of the story and he told him what happened and if he sees the guy wearing it again he will shoot him. The cops advised him not to shoot the guy then went and told the guy "I wouldn't wear that helmet any more if I were you". If he saw the kid he probably would have done the same as you but a lot less politely. Down here there are a lot of military bases so all the thrift stores have a lot of uniforms so any Jackass can go in and get one. We catch. A lot of criminals wearing them trying to be camo'd out to help them hide. It's pretty sad but I don't think I've ever seen someone blatantly wear a full uniform incorrectly.
