Okay, i need some advice

 

My old roomates are jerks and my life there was hell. My student loan check was accidentally mailed to my old address and they have it in their possession. They promised to answer the door when i came over and wouldnt. So i've told them to leave it in the mailbox and i will pick it up and they havent done that. How should i go about getting this check. i'm broke and have to have it and it's a substantial amount. I refuse to ever speak to them face to face because all they do is scream and threaten me (and i'm a girl, so i cant really handle 3 grown men screaming at me all the time) ...any suggestions????/

sorry to hear that its that shitty. but i like howards 2nd idea. The last thing any one wants to do is break a federal law. Just threatening them should get you your way. If they say they lost it or anything along those lines get the authorities involved, its just not worth the stess of life dealing directly with assholes.

Call the police. Say they have threatened you harm in the past and you are scared to go alone and do not want to take large friends to fight. They should be able to go on location and get it or escort you.

 

Either that or offer free pizza and beer and invite some CR'ers to go with you.

 

Try option 1 frist though.

Maybe you could call the bank that issued the check and have a stop payment placed on it. They can reissue another check to your correct address if other plans to retrieve it don't work out.

Due to this qualifing as a domestic dispute, the police WILL escort you to the door. I would not contact these men and treaten bringing the police, just call CPD and have them go with you. Thing to do is do it on a Friday night when you know they have been drinking. Two reasons, one is that booze makes people do stupid shit that will get them arrested, second is that being underage and drunk, if they are underage, or anyone there is, will get them hauled off to jail.

Not sure they could be convicted of a federal offense (i.e., stealing mail) - after all, they live there too, and the mail's coming to their address. However, if they opened the mail with the intent of defrauding the contents or cashing the check, then that's a different story. (Though I'm not sure they've done either of those things.)

 

I wouldn't be surprised if CPD aren't terribly receptive, especially if you call them and ask for an escort. I don't know the law, so I'm not sure if, legally, they are obligated to provide an escort. Then again, in my experience, it seems like CPD, in good faith, would provide an escort, particularly given the parameters (e.g., a woman with men as ex-roommates, her trepidation about returning, etc.).

 

Taking over some bruisers to strong-arm the check out of them may backfire. All the roommates would need to do is look out on the porch, see your meaty friends, and then call the police to frantically report that you're bringing by goons to work them over. They may just very well convince the police that they are the "real" victims in the situation, leading the police to view you as the aggressor and the party at fault.

 

Maybe you could have a convincing friend call, act as though they are an attorney, indicate that they are representing you and that, in order for them to avoid legal prosecution, they must deliver your check to a specified address within two business days. After all, you can always use the force (i.e., the strongarm tactics) at a later date if other options don't work.

 

Also, I agree about calling the place where the check was issued and letting them know the situation. It may be easiest just to have another check issued. Also, they'll be able to tell if the check has been cashed (and thus tip you off with respect to any fraud/theft on their part).

 

Additionally, you can call just about any attorney in the phone book and receive a free, albeit brief, consultation on the matter.

It is stealing mail because it is not addressed to them. THeir name is not one it, and they refuse to give it to him, therefore they are stealing his mail.

Like said above. Call the police. If that does not produce the check, call the bank and have a new one issued. Your school's financial aid office will have on file the contact info of the bank issuing the check.

 

As for the "bring some friends" option, Me = 165 lbs. graemlins/bubbrubb.gif Maybe one of these fellas can just pick up and use me as a big baseball bat to beat the shit out of them with. :D

It has been my experience that smaller people aren't to be underestimated. I suppose it has something to do with having to survive in a big world that makes em that much tougher.

 

I'm 6' 325lb and I'm more afraid of pissing off my lil' ol' 100lb sister than someone twice my size. Heck, take my wife for another example. She stands a whopping 5'2-5'3 and commands such an aura of no-nonsense 'tude when jaded that the 'Candyman' himself would blanch! graemlins/wtf.gif

have the univeristy stop payment on the check and have them issue you a new one to your currect/current address. (not sure how long that may take just trying to give you another option if you dont want to confront them.)

If they live there, and it has their address on it, then they cannot be accused of stealing it if it simply delivered to their residence. To take it to the absurb (but still abide by your warped logic), we've all committed this so-called federal offense whenever we've found someone else's mail (e.g., a previous tenant) in our mailbox.

 

Now, if they are withholding property that rightly belongs to another, then I'm sure that qualifies as some crime, though I'm not sure it would be stealing.

Look, some people know that I am a Police Officer, so if you want my opinion here it is. I see that your profile says you live on the east side and in Columbus that means either 9th or 14th precinct, luckily for you two of the most busy in all of Columbus. Which means CPD will either tell you they are too busy or not show up at all. If you are going to file a report, do not file it with a police department, as they are just going to forward it to the post office anyway. The post office handles these things daily. Get with someone there. I would stop payment on the check and have a second one issued to you.

It does not have their name on it. The mail does not belong to them, they will not give it back to her, they have stolen her mail. My logic is not warped, it is correct. Think about it for a minute. If you live with your parents, and own your own car, you will have your name on the registration. The car is registered to you, and you alone. Just because the car is registered to the same address as your parents doesn't mean the car belongs to them too. If they wouldn't let you take your car, you could report it stolen and they would be arrested. I know it is a weird example, but it is the only way to describe it.
