Article 1, Section 6 of the Constitution says the following: "No Senator or Representative shall, during the time for which he was elected, be appointed to any civil office under the authority of the United States, which shall have been created, or the emoluments whereof shall have been increased during such time."

Translation: A lawmaker cannot fill a position if the salary for that position has been raised during that lawmaker's term in office.

In January, President Bush signed an executive order increasing the salary for the secretary of state and other Cabinet positions by $4,700. Hillary Clinton has been in the Senate since

Soooo, it'd have nothing to do with Condi being a genius....literally. It'd be solely cause she's black....ahhh, got it.

there's no doubt that she's a very smart lady. I don't know that she's supremely qualified for the job though.

On that point I dont think Hillary is qualified at all.

Yes, I think she was.

The Secretary of State's job is quite a bit different than the VP's though.

I'm not overly impressed with Rice - and it has nothing to do with her being a woman, or with her being black.

Again, she's more qualified than the current pick.

No, I think it can be done in the house and the senate.

Bush doesn't have anything to do with it.

I'm about 99% sure congress has to pass it, AND the president has to sign it.

Technically and constitutionally, no. "CNN legal analyst Jeffrey Toobin" isn't correct on that.

ok qualified has two meanings. it can mean fitted for a given purpose (competent) or having complied with the specific requirements (eligible)

was palin competent?

not in the least

was she eligible?

yes she was. she was born in the US and she is older than 35
