I'm definitely not going to be sue happy but will make sure I'm taken care if. Gear, bike, hospital and the pain that I'm going through. I'm picking up the bike tomorrow so we shall see what the damage is . I feel extremely blessed right now, so I hope this has opened up the eyes of others who choose not to wear gear. Just because someone wants to be reimbursed for their property and health care cost's doesn't mean they are greedy or "sue happy". You're right it was an accident but an accident that was the fault of one individual and thus he should be held responsible. Nothing wrong with that. Worst part is he'll probably be experiencing pain for weeks. Back/neck pain can be horrible and persistent. Glad you got out with your life but its still going to be a painful recovery. If you are stopped and someone hits you from behind, they are liable whether they were on their phone, having mechanical issues or just not paying attention. They are caused by the actions or inactions of one or more people. that's what insurance is for... nothing wrong with getting your medical paid for via auto insurance... any more than that plus getting property repaired is ridiculous... So you get ran over by a drunk driver and have to miss work for 4 month(unpaid), will have back pains for the rest of your life, and as long as your medical bills are taken care of you are okay with that? I agree, future medical visits, which in turn is taking time off work. this is all things i will need to due. After some thinking, the medical bill right now has been pretty high and thinking about just getting an attorney to ensure everything gets covered. So if anyone knows of a good motorcycle accident attorney please let me know. Glad you are ok. I'd have your doctor take a look at it. Manufactures/companies say the same thing for hockey helmets (I know not exactly the same thing, but pretty comparable with concussions), but the CBJ concussion specialist that looked at mine when I had an on-ice concusion said it wasn't needed as the material wasn't compromised. that's what insurance is for... nothing wrong with getting your medical paid for via auto insurance... any more than that plus getting property repaired is ridiculous... This is ridiculous. There are people who suffer the rest of their life for similar accidents. You may never live the same life ever again. You should be reimbused for that. As for the helmet, if it didn't smack anything then it should be fine. From my years of roadracing I used the chip/scratch rule for my helmets. I've gone on some VERY high speed tumbles, but sometimes the helmet never touches down, or in one case, only hits the visor. I only replace if there is visible evidence OR if the helmet is over 5 years old (manufacture date). This is due to the nature of the helmet's safety cushioning slowly breaking down, and the safety rules that are designed because of that. I would definatly get a lawyer. As for gear upgrades.
