If they can't prove that then they have no case. It could be that she crossed almost the entire street and would have been visible to him for several seconds before impact... Or it could be that she stepped out and was hit immediately and even a sober driver would have no chance of stopping. Will have to see then they post the accident report.

I still don't see how this accident it an Aggravated Vehicular Assault. Being drunk doesn't automatically make him at fault for the accident, and she crossed the road outside of a crosswalk, at night. Were the circumstances such that had he been sober would he still have been charged? What was it about the accident that makes the police think that the DUI contributed?

The pistol rounds won't make it out of the safe. Even if they do they'll speed off into an empty field. Plus I don't want to have to rack/load and unload every time I touch them (putting them on for CCW etc). The less handling, the safer. The shotgun is mounted in a quick-release mount facing upwards on the top floor - no risk there. I'm actually going to remove the round from the chamber of my AR - it's the only firearm with the power to shoot through it's own safe, and for that bullet to be travelling in a dangerous direction. If I can't get it done with 30 rounds of 5.56 then I don't think the extra one will help much.

They never did seem to name the drive publicly. Although the accident was August 19th neither the State nor OSUPD appears to have any record of the accident. I know the driver was charged with Agg Veh assault, but I challenge that concept because the accident was not his fault. Unless they can prove that a sober driver would have stopped in time to avoid the drunk (reportedly) jaywalking (proven) girl... But I can't find a status for that case. EDIT: Got a name - William Anderson, 21, OSU student. But now FCMC has nothing under this name. Possibly William is a middle name? EDIT: William C Anderson. Charges apparently have not yet been filed, and the accident report has not yet been finalized.

As stated by BTD above... A civillian in the same situation was handled the same way. I think the issue was that Casper thought that pedestrians have automatic ROW everywhere. That's what happens in Russia - in all car/pedestrian accidents the driver must compensate the pedestrian. Those of use who learned firearms handling in a military setting were not allowed to make that mistake. Ever run around the base holding a Lee Enfield .303 above your head? I was certified on: - Lee Enfield .303, (5-round-clips, loaded into an non-detachable internal 10-round magazine). - .22 version of the Enfield, while I was on the cadet shooting team - L1A1 SLR (Semi-auto FN FAL) (20 or 30 round magazine) - L98 A1 GP (Single-shot variant of the SA80) (30 round magazine) Never got a chance to be ceritifed on the the GMPG (jimpy) or the Bren.

For future reference - don't ask a mother to pay for damages caused when you run over their child, even if it was 100% their fault. Will not end well. This is a universal fact. The correct answer is: File through your own insurance, then let THEM pursue reimbursement from the pedestrian's family. They won't back down when yelled at.

He should be charged with any crime that he committed. Just because he feels bad about it doesn't mean he should be forgiven. Parents who leave kinds in hot cars don't intent to hurt anyone, and they feel bad about it - but they are still charged if the prosecutor feels the parent was negligent. I think he should be charged with involuntary manslaughter. As the victim was under 12yo, under PA law, this is a felony 2. For this, under PA Code 303.15, this is a gravity score of 8. http://www.pacode.com/secure/data/204/chapter303/s303.15.html Gravity score 8 sentencing is 6-18 years, with a + or - 6 year mitigation/aggravation correction range. http://www.penn-law.com/lawyer-attorney-1831194.html So, according to my cursory reading of these laws, if he is convicted of F2 Involuntary Manslaugher the judge can sentence him to no time at all. Or he can sentence him to 24 years. A lot will depend on this guy's history. Are the guns legal? Is he allowed to own them? Has he been convicted of breaking any gun laws in the past? Does he have an established pattern of poor handling of firearms? Assuming he's just a regular guy with a clean history and character witnesses that will state he normally has very good firearms handling procedures and this was a one-off accident then I think it would be appropriate to convict him of F2 Involuntary manslaughter but his jail sentence can be very low, if anything at all. Probation even. The key is that he'd have the felony record and lose his guns. Any kind of bad history at all and serious jail time is appropriate.

When my brother was younger he was hit by a car that was speeding past the school bus at let-out time (no stop-for-school-bus law in the UK). Police never cited him because it my my word against his and my brother ran out from behind the school bus. As my mother and I were in the waiting room at the hospital, not even sure if he was going to survive, the owner of the car came in and told my mother she would be paying for the damage to his car. Well, I don't know what she said to him because they were too far away, but he turned his ass right around and never asked again.
