Hate to say this, but your lawyer friend might not have looedk at precedent. There are several cases throughout the country where lawsuits have already happened. Poker runs, charity rides, group rides, etc. Like I said before, it doesn't matter if it's a case you could win. You'd still have to pay to defend yourselves.

You likely would be fine. Odds are nobody is going to sue you. But that's a risk you'll have to take. It's like driving without car insurance. You'll probably be fine, but then accidents happen.

By the way, waivers mean very little in court. They help, but aren't foolproof.

And that is the single largest frustration I have with the "American" system.  I think that people who successfully defend baseless lawsuits should be able to recover reasonable defense fees.  The problem is that it just opens up a new can of worms arguing over what is "reasonable," and what is "baseless" etc.
