That is pure speculation. They could have reach a Plea Bargin as well. The only way you could find out is Linn, His Attorney, or the Judge. I believe this means the judge is not willing to make a decision. "Without prejudice"= he has no personal stake in the case, he does not nor ever has represented the defendant or know personally. Based on whatever "motion", the prosecution/defense has asked for, and remands the case be turned over to the grand jury to see if there is enough evidence to go to trial. TTQ B4U Posted July 19, 2008 Report Share Posted July 19, 2008 Case isn't over. All that happened is the Judge granted the motion for the defense to have a grand jury decide. They will let him go about his business for now.....the judge likely didn't have a choice as the defense has the option to go before a grand jury. However the prosecutor will decide if it's worth pursuing and has a window of time to decide that. If so, Linn's case will go before a grand jury. So basically the prosecutor has to do his job. No big deal really, they are state workers and will clock in and earn their keep. IMO, with the death of George and his victim's family still being upset and the other member here with the blue Evo that died (even if he wasn't racing), it being an election year all combined with the fact that Delaware will likely want to continue proving itself more aggressive in these situations than Franklin County, odds don't look good. The prosecutor will likely let this hang out there for a short bit and use the possibility of a grand jury looking at it and the potential consequences as leverage against Linn to gather more strength against the other cases and lesson any deals they may ave to make with them. After all, everyone is trying to make a deal and the prosecutor is holding some good cards in his hand. However, they may make an example of Linn too. It's very likely they know they have a major instigator in this type of behavior in the system now. It's not over yet. He just simply is "walking away" without any decisions against him, including points and what not for the time being because in reality the prosecutor has a much bigger rock looming over his head until he lines up all his ducks and decides his next move against him. **EDIT** Reading owns me. The case is dismissed. Hence the Judgment Entry. For whatever reason the court reached a deal with the attorney. This means it won't have to go to Grand Jury or even Trial.
