  2. We got a brief denial letter from the Mothers insurance company. No explanation, just said 'we respectfully deny your claim' So with that, the police report, and repair estimate I can submit BMV form 3303 on both the owner and driver.
  3. Typically the car is cover'd, At least I know my car is cover'd no matter who drives it, so long as they are a legal licence driver. My HO ins. said they wait until the very end to start any contact with drivers insurance or any subrogation. That way they have complete dollar amount to go after.

  6. Any proof of insurance would be nice! I shouldn't be the one flipping for the (2) $500 deductibles, 3 if I claim the damage to my atv trailer. I have no idea whats on there card, I have never seen it. I don't see how when the magistrate ask for proof of insurance, you could simply flash him anybody else s insurance card and that be good. My home owners ins will cover me less the deductible, and they will go after the OP insurance. As far as the car goes, same thing, but as of now i cant even get it out of garage for a estimate. I'm hoping they suspend there drivers licence until this is fully paid back to my insurance companies. Unless my insurance agency's backs there's into paying anyway, which is what I for see at this time. And I still hope to seek leagal advice as far as loose of use and pain in the ass reimbursements... Under Ohio law, in the case of a motor vehicle accident, both driver AND owner are responsible for making sure the operation of the vehicle was covered by insurance.
  7. Just my luck. I think she forgot the purpose in asking for it, as long as it took him to find it. The magistrate was in the middle of the next case when he came back in with something. I'm sure it was just a copy of his mom's insurance, but who knows.
  8. We wasted a couple hours today at court. The driver had traffic court, so we went to hopefully see them jerk his licences or give us the prof of insurance since it was never really provided and left off the police report. Well the clerk and prosecutor tried to help, and had the magistrate ask him for his proof of insurance. He went through all his pocket's at least twice, then told her it's in my phone. She said well go get your phone, he went back up and asked the clerk if he gave it to her? Like wtf is it a card or in your phone? So I'm not sure what happen'd next, but he was given till 3/31/15 to pay like $140.00 and he walked out, and returned with a piece of paper. The magistrate said oh you found it, he approached she asked for the file back and put a check mark in a box, We never got any proof!!! We talked with the prosecutor and was told to just sue him civilly. We were't there to sue just to get ins proof or him to loose his licence, we didn't achieve either! Were waiting on a denial letter from the mother's insurance agency. She called us today and said they were not going to cover it, and she knows she's at fault for letting him drive uninsured. When we get the denial letter were going to send it to the BMV along with form 3033. And hopefully they will suspend his driving privileges. Here's what this fine outstanding citizen decided to wear to court toady. Looks good, if you like the pants below the ass look... As far as estimate's I've had 3 company's come over so far. One is sending there mason by tomorrow to take a personal look. And one submitted a est. of just over 13k with some open end items, like permit cost and inspection fee's and some other jiberish. I thin this will be the lowest estimate of the 3, because of the way the other's said the roof would have to come off to properly re-brace it to the block wall.
  9. Thx, and yeah I believe your right about the lawyer. Even so we are still going to reach out to a few, and see what they say, As far as I know my insurance company will fight for the damages, and I have no right to that other than my deductible..

    I have a few shares of Textron stock. When the market crashed I lost my ass. But researched a lot wondering if I'd loose everything. Decided it would turn around, which it has so far. And when it was near the all time low I reinvested.

  12. GD I received a copy of the bill for the emergency board up services. Total material used (6) sheets of 1/2" 4X8 chip board plywood, (12) 2X4's 8ft long. A box of 2 1/2" and 1 1/4" drywall screws. One guy was there maybe 4hrs another for 3. Part of time spent was going back to Lowes for more wood. My father in law and I helped 1st guy, cut and remove the door and debris. And job was temporary at best. They just angled 2 screws in per 2x4. And left a nice size bird hole, you could toss a football through. Idk why it took them as long as it did, but they were there from 5-9. I'd love to see the itemized bill. $1660.18

  16. My home owners and auto insurance are both different from the at fault parties. The car that did the damage is cover'd by First Acceptance. I personally have never herd of them. I don't think they are connected to any social media, but idk for sure. We still have not herd back from there adjuster. I meet with the owner today of http://buckeyerestoration.com/ They seam really professional and used common courtesy, from the 1st phone call, the conformation call, and the in home inspection. I didn't get a $ amount estimate, he said he needed to make contact with my adjuster 1st. He seamed to think the whole south wall, east header wall, and part of north wall needs replaced. And said he'd quote the job for complete inside painting and out side stucco. And then told me to paint the inside, I'd have to clear out the entire garage! I sure hope my insurance figures this expense in, as wel, as the repair cost. I'm going to ask for safe storage on the car, for the time of repair if possible. I hate to park the Stang on the street. Maybe I can plan it to be repaired the same time the garage is being rebuilt...
  17. That sucks on the roof. Back in 2007 I had the same company that did my roof, give me a estimate on my late Mothers house. Some friends and I did the roof in the mid 80's. So it was a 20 some year old asphalt shingle roof. They cleared it for a hail damage claim! Paid 100% to tear off all siding, gutter's, down spouts, wrap windows, tear off and replace roof. And company doing the work ate my deductible. There was no talk about pro-rating the roofs life. The siding was cover'd 100% because they couldn't match the (faded) color. So insurance paid for it all. Anyway I hope it works out for both of us. She could have, but she didn't. Even so Idt the police would of sited him for it, if she reported it stolen. There insurance agency is still dodging all calls and returning none. I have a contractor coming tomorrow for a est. And then on the 4th, my Home owners ins. adjuster will be out, along with 2 other contractors. One they recommended, the other I called and they wanted to be there at the same time!
  18. Come on now anyone with $75.00 a few spare hrs. and a clean background can get a ccw. After this he wont have a license to drive a car, but can still pack his pistol hanging out of his pocket....Just a matter of time before he looses that license as well, if you ask me.   19. Okay so even though my car was parked in a locked garage, it still fails under collision insurance. My car agent seams to think they will get the OP insurance to pay, even if the son wasn't listed? IDK but hope he's right to save me the $500 up front. The insurance companies have the 1st right to collect from the OP. And let's not forget about all the proper etiquette they used, while in this citation...And there wiliness to share there insurance info and DL. The language factor alone in my book far out weighs the outfit. Ray Charles would of called it the same way.
  20. As far as the judge Judy comment, I believe the op would have to agree to this. And as for the attorney, I was hoping for one that does the 'we don't get paid unless you get paid'. I know usually when in a accident, the agencies that troll the police reports usually start calling. I do know I don't want to pay the 2 deductibles let alone attorney fees. Not so sure my insurance company will screw me. If I get that vibe, I will certainly pull the e-brake and contact more contractors for estimates. Which I will most likely do anyway, just to compare the two methods of repair as well as total price.
  21. Car is not covered by homeowners insurance. And my deductibles are the same $500 each. Per my agents. I have Allstate on the house, and Geico on the car. I need to dbl chk my policy, cause I thought I had 500/250 for comprehensive. I don't see why this would fall under collision deductible, when my car was parked in a locked garage.
  22. Yeah just property damage, no one was hurt. And I do think a lawyer chat is in the future. Others have said we can sue for distress? Just the whole thing sucks. I have my car and toys all boarded up, and wont be able to access them if I wanted to. Atleast untill I get my garage rebuilt, which mostly will be awhile. Builder and insurance adjuster will be out on the 4th.
  23. Car has full coverage, but still a $500 deductible. I guess from what I understand at this point, if I use my insurance I can't sue. My insurance companies have that option. And I was told if they recover anything from the at fault parties, the 1st $500 will go towards my deductible. And I believe they will also file with the BMV for driver's license to be revoked, for driving w/out insurance.
  24. Owner of the car's insurance adjuster contacted my wife weds evening. And told her as it looks right now, they will not be covering the claim. Due to the fact the driver 'Son' wasn't listed on the policy! So he lied about having insurance, and this is probably why the officer wouldn't let me know anything. Just kept telling me I will get all that information on the police report. Well as soon as the report came online, the wife pulled it up. And you probably could of guessed it, but the spot to check yes for proof of insurance was left blank! As well as the insurance company name. Now if this was me, I have no dought my drivers license would of been confiscated on the spot. Along with several tickets written out. At this point do I just leave it up to my insurance co. Or do I seek legal advise, and make a case on the driver, and car owner?
