  1. I see most now have cameras that do it automatically. Can't speak for LEO's but I don't think they even need to run plates manually much any more. They just simply have to drive by you.
  2. Good points. I don't understand the details of the technology, but you're right, I wonder how or if the iMessage would even show up in any records once you delete it. Even within your own phone. I mean, I'm sure it's "saved" somewhere, but is it retrievable? Note to self, if I get into an accident, make your iPhone die a good death immediately. Especially if you were using it. Or just turn over the corporate phone that I have but have never used and just let sit in my bag.

Last I checked with myself, I'm not letting anyone persuade me to do anything I don't agree with, thus if I do as you're implying, it's my fault and I am accountable for what comes from those actions. Shame on me, not the officer or the law. How is it that you see this differently? If you are persuaded to do something then by definition you made that decision. I see no abuse of power in that. I see poor judgement. No missed points here, I can assure you of that. If any halfway intelligent person permits a search of their car, they get what's coming to them if something is found. I can't fix stupid, so to all those out there who are stupid, that's on you. Know how to interact with others, including LEO's. Again, that's on them. I don't see refusing a search as hassling an LEO. It's just life and business man. People need to be aware of how to handle themselves in life. It's their fault if they cave in to such basic requests.
  6. If the situation lends itself to a warrant, know that warrants clearly define what bits of information can be obtained. If you bring your records to court all you need to bring is what's directly related to your case. Just redact the rest.
  7. I would welcome such treatment as I would eventually have a nice trust fund for my kids. Especially since the Ohio Supreme Court has ruled that police must have a warrant to search the data on a cell phone that is lawfully seized even during an arrest, let alone a traffic stop.
  8. Interesting articular, but if someone is dumb enough to 'hand over' their phone then they get what they deserve. I'd make it very clear that I am going to show the officer with the phone in my possession that I wasn't doing anything and if that wasn't good enough, I'd see them in court. I likely wouldn't even go to court, I'd send the records to the prosecutor ahead of time.
  9. 100% not the case if the phone records show you were not texting at that time. Cop can say it all he wants, but records > his word. Easy one for you to prove, even without an attorney. How's that any different than turning over your insurance card to prove you have insurance?

No. If I'm simply changing songs and am pulled over for another offense (texting isn't a primary offense) and the LEO tacks on texting while driving, I can simply show him my phone, lack of texts or emails and discuss it with him there. I doubt he's going to press the issue if you clearly show him otherwise. Why would they? If anything if you are innocent and prove it to him and he still cites you and forces you to hit the courtroom, you stand a decent chance of getting both citations kicked.
  11. How so? If you're cited and choose to fight it in court, you're not found "guilty" nor do you have anything on your record until after you go to court. Ticket is just simply a citation, just like your signature isn't an admission of guilt, only that you accept the option of either paying it or fighting it. Until then, your record is clean.
  12. I doubt an LEO would even try. All they have to do is cite you and meet you in court. It's not their job nor likely their care to debate you on the streets of Cbus. Due process man. Overtime for them I'm sure. If I were a cop and cited you and we disagreed or you said "prove it", I'd refer you to the court date appearance and wish you a nice day. My guess is pulling cell records is common practice already anyway.
  13. Agree. Max company 401k up to matching point at least. Personally, I like the tax deferred savings so I max out my 401k at work every year. If your family income is in the range of a ROTH, then max that out too. After that, look at other investment funds or programs with your financial planner. I can't speak for your situation, but will give you what has worked for us is that if possible, never spend a dime of the lower income of the two in your household and invest it completely. Some will say they "can't do it" and perhaps some can't but IMO most everyone can if they really try. We stuck to this rule for the better part of 15/18 years my wife had her law practice open and it's what has put us in the position we are in now. That and buying a very modest home which we paid off in 15yrs. I absolutely would do it again and will do so if/when she chooses to go back to work. Even if she never does, we banked 15 yrs of serious income that have relieved just about any issue of stress about the future of our nations economy. The itch of a car bug is all I really have to resist. I alleviated this by framing the titles in my office and have to look at them daily to resist temptation.
  14. Here too. never really did until recently now that the iPhone will allow seamless voice to text message. Works flawless with the hands free sync system in the Ford. Just press the home button on my phone and tell Siri what I want to do. Sync always had the ability to read my texts back to me as they came in but now I can do both hands free. Granted it's not as safe as just simply driving when behind the wheel, but then people rarely just drive any more. This. Although I suppose it would make for an interesting case if something happened. Technically I'm texting, but with less hands on contact than looking up a contact or ph# which the law allows for. No one is telling you what you can or can't do in your car( while not driving). When you are in your car on public roads with others around you, is a completely different story. Driving is a privilege not a right. What puts your texting as a higher priority than the safety of those around you?

  16. Gotcha. Didn't have the details. Guess GM isn't really stepping up. Hell, even our Hyundai Minivan had a 5/60 coverage on these types of issues. Water in the dash shorting out all that hi-tech Caddy stuff is going to hurt the wallet hard.
