Carolyn Havens had a civil protection order against her husband, however, so Champaign County sheriff's deputies arrested Timothy Havens on Monday.Carolyn Havens, 42, is in critical condition in Miami Valley Hospital in Dayton, where she's been since the Sunday shooting.Timothy Havens, 38, called authorities about 7 a.m. Sunday and said a .38-caliber handgun had been lying next to the bed, and he picked it up and threw it to the side."We were having sex and it went off," he told the dispatcher.He said his wife was breathing alright and doing just fine.According to court records, Carolyn Havens had a protection order in place in September when Timothy Havens came to her County Line Road home and argued with the family and assaulted a stepson.In October, Timothy Havens pleaded guilty in municipal court to violating that protection order and to one count of assault. He was given a 60-day suspended jail sentence and ordered to complete anger management counseling.Champaign County Prosecutor Nick Selvaggio said in light of the shooting, Havens was hauled back into municipal court and the 60-day sentence was re-imposed because he violated the still-standing protection order.Selvaggio said he will present the case to a grand jury Dec. 11.Timothy Havens is in jail on a $75,000 bond.
