1) a penalty

It absolutely does matter that he was a runner. The fact that he wrapped up means the refs are going to determine it to be incidental and not spearing. The rule explicitly excludes incidental during an actual tackle of a runner.

 

Its an unsafe tackle yes, but the refs will never call that.
