Ticket/advice needed!!!

Leading a small group down 93 this morning, As I crested the hill coming into town I see a cop parked @ bottom of hill pointed same direction. Was going 37 when I came up to hill slowed to 30 when I saw him. Guys behind me didnt see him and closed on me pretty quick, second guy passed him and he put his siren/lights on. Pulled over to wait for him to write the others their ticket and he asks me "what the hurry was, I clocked you at 45" Politely explained their was no way I was going 45. And he writes us all for going 10 over speed limit, Saying he had us "all" on the radar going. Cant have any points. Think I can beat this in their court. Need some advice on how to do this. This was in New Straitsville btw.:postcop:

I am not a LEO but I don't think they can pin point each bike in a group. But since they can write you a speeding ticket just based on just a visual anymore, you may be screwed.

Why didn't you guys run? Can't catch all of you.:lol: j/k

Seriously though, I've always heard to go to court and plea bargain with them for a no-points violation. I can honestly say that I haven't had ticket in probably 12 year (now I'm jinxed for sure...)

I think the plea for no points would be the best scenario, Its a $96. ticket, I'd lose twice that to appear but if I can get off w/no points it would be worth it. The "i got you all on radar" is the thing I don't get.:mad:

Not sure of the size of your group, but no way possible for him to get an accurate reading on all bikes in the group.

I agree. He clocked the first bike and then most likely the rest of the pack as a whole.

Radar produces a wide signal which can't destinguish between objects close together or traveling about the same speed.

But, its a safe assumption that the pack is going about the same speed as the lead bike so if he got a "over the limit"

read on the lead bike you're all kinda screwed anyway.

LASER on the other hand, can accurately pick out a single vehicle from a group.

Yea, send in a motion to compel discovery and specifically ask for the audio evidence (so you can hear the cop saying he got you all on radar) Worst case, you might have to send in a subpoena for that evidence.

If he "got you all on radar" then he just admitted that the radar had reflected off multiple bikes and because of this reflectivity, had no TRUE clock on any of the bikes. Go research radar reflectivity. Simple physics will explain your case.

Should have kept your mouth shut and just nodded. From your post, it sounds like he wasnt going to ticket all of you. Since you "politely" disagreed with him, he said fuck you and gave yall tickets.

You have the right to ask to see the radar because he locks the speed in. I've had a cop show me before and he walked it over to me. I don't know how he can ticket everyone though because he'd have to prove everyone was speeding.

You do NOT have the RIGHT to see the radar. The officer may show it to you as a courtesy, but that's at his discretion based upon many factors:

- Does he feel YOU are safe to be wandering around? (side of a freeway = no way)

- Does he feel HE s safe for you to be wandering around? (Acting belligerant = no way)

- Did he even lock the speed in?

- Does the gun allow the speed to be locked in?

- Did he take further readings while you were decelerating, so the latests speed reading was a legal speed?

- Are you going to use that as a new argument? ("You just left that speed on there form the last car you pulled over, didn't you?")

I've never asked for an officer to show me the reading. I was pulled for speed 4 times in a three year period right after I moved to the US. Two were ticketed, 2 were warnings. One officer offered for me to see the reading out of the blue, and the others didn't. I did accept that one officer's offer as I'm from a cop family and I wanted to see how the US speed gear compared to UK stuff. Otherwise, the numbers on the gun are an irrelevance to me. If it's on the ticket that's all I care about. I was more eager to end the police contact as soon as possible as it is a stressful thing for me. Been clean for 10 years, touch-wood.

I thought it was strange that he offered to show us the radar that was mounted to his dash locked on 45. He said the radar gun is mounted in the front and rear windows(I looked) But how he can say we all were @ 45 is a load of crap. I dont know what to expect when I go because the ticket says "mayors court" Its probably his brother the mayor.

Hmm Ohio laws must be different, in Pennsylvania, if you ask to see the radar gun they have to show it to you. they are all issued guns that lock in, I've never tested it in court but everything I've been pulled over in PA I have asked to see it. All of them escorted me to their car and showed the reading to me. I knew I was breaking the limit just wanted to see if they actually had the reading or not. I believe if they don't lock the speed in and you ask to see it, they cannot issue the ticket. Could be wrong but I believe that's how it worked there.

Last time I got pulled over in Ohio it was 102 in a 65.....I got a ticket for my tint and license plate covers. The time before that was a 92 in a 65, He gave me about everything he could including WO, I got it knocked down to a 72 in a 65 and no points.
