Pulled over today

I was pulled over today.

 

It was on I-70 and yes, I was speeding, I was driving 70 MPH. I was apparently "paced" and pulled over about a mile past the porn shop on I-70E.

 

The cop came to my passenger window and stayed out of view (standard procedure I am told). I informed him that I was Deaf. He proceeded to yell at me as it would help me understand him. I couldn't understand anything he said so I said "What? What?" I even signed that I didn't understand so he finally roughly gestured for a license which I gave him.

 

He left and came back with a ticket and stood above the door where I couldn't see what he was saying. He basically ordered me to sign the ticket (put the ticket in my hand and pointed where to sign). He left after that.

 

Is it even worth fighting?

I was going 70 in a 65 zone then it changed to a 55 for a mile which I really don't change speed for then it went back to 65

 

It looks like Michael J Fox wrote the ticket. He apparently put me down for 70 in a 55 zone.

Police officers are required by the ADA to ensure effective communication with individuals who are deaf or hard of hearing. Whether a qualified sign language interpreter or other communication aid is required will depend on the nature of the communication and the needs of the requesting individual....

What basis do think you have to fight? Signing the ticket means nothing.

 

Depends on where you sign... one spot means "I acknowledge receiving this citation, and that's all I'm gonna say," while another means "I'm a worthless loser who pleads guilty. I did the crime and I plead guilty. Oh, did I mention that I'm pleading guilty? Because, you know, I plead guilty. That's how guilty people like me plead."

 

(And as anyone who has gotten a ticket can confirm, that's about how often the phrase "plead guilty" shows up next to that line... you have to be an illiterate moron to sign there if you have the intention of fighting it)

I usually don't fight a ticket like that, if you were going 70 when the speed dropped to 55 then there isn't much to fight. If you have points on your license it may be worth it to you to try and keep the points off.

 

Sounds like a typical dick of a cop, couldn't even try to communicate with you. Was it state highway patrol?

Should have a sign ready made in your car and hold it up and say "I'm deaf fucker.. stand in front of me".. or something along those lines.

It's shitty service. I got a ticket last week for no front plate. I was even I. Uniform and the guy treated me like I robbed a bank. If there hate their job and the people they deal with, leave. But the benefits are good and it's stable, I'm guessing. It bugs the hell outta me when a cop or other public service representitive comes across like they don't care.

 

Dude was speeding. He knows that. Cop could have made the situation better and was lazy, is how it sounds. Send a letter in that explains the situation. Include the cops info and be very respectful. Identify the difficultly you experienced and that your handicap was ignored, leaving you confused in the process. Recommend a more thorough understanding be made between cops and persons who are deaf. Hope you hear something, but don't expect to.

If you were doing 70 in a 55 you're just an asshole if you try to get out of the ticket on being hearing impaired. You're hearing impairment didn't stop you from seeing the speed limit sign or your speedometer. Especially if you try to use the ADA or something to that effect, even if it could help you from a legal standing, I would hope that's not the intent or the spirit of that law. PAY THE TICKET. If you go to them bitching about how the cop treated you and you are trying to get out of the ticket, it will just look like you are trying to use your disability to get out of the ticket. If you pay the ticket then you have an honest issue to raise about how the cop treated you. Since you were admittedly actually speeding the two should have 0 to do with each other.

 

Again, hearing impairment aside, I have 0 issues with someone going to court on the merits of the ticket and how our legal systems works to try to get a reduced fine/sentence/whatever. That only has to do with the ticket and what you did or didn't do.

i'm guessing military uniform? maybe he thought you, as a service member, could follow basic orders i.e. license plate laws, without having to be told do so by LEO

Go to court, plead your case, tell the judge you dont mind paying the fine, just dont want the points on your license, pull deaf card, and hope they buy it. You are paying a fine regardless.

 

How does pulling the deaf card hold any ground in court for a traffic violation?

 

If that were the case I'm fighting every ticket like this, "Sorry judge, I have chronic Sinusitis and it makes it really difficult for me every day, so please don't issue me tickets or points on my license."

 

It's a fucking ticket for speeding. He did it. He admitted he did it. Being deaf did not cause him the ticket, so, why do people have to blame other shit for their actions? Take it like a man and move the fuck on.
